Military and intelligence gathering activities will likely become more intensive, intrusive, controversial and dangerous. Regarding the regime covering these activities, there is general agreement that the exercise of the freedom of navigation and overflight in and above Exclusive Economic Zones (EEZs) should not interfere with the rights of the coastal State in the EEZ. But there is disagreement regarding interpretations of relevant 1982 UNCLOS provisions, the means to resolve the disagreements, or if there is even a need to do so. Increased dialogue between maritime powers and coastal States is necessary to reach a mutual understanding of key terms with a goal of developing some agreed voluntary guidelines for such activities and the means and manner of implementing them.  相似文献

Regarding the regime of military and intelligence gathering activities in the EEZ, China argues that the freedoms of navigation and overflight in the EEZ have certain restrictions including that the activity must be peaceful and not threaten to use force against the coastal State. This includes military surveys, military maneuvers, and military reconnaissance which are a form of battlefield preparation. These activities are also subject to due regard for the rights of the coastal State. China also argues that there are serious shortcomings regarding the regime of marine scientific research (MSR) in the EEZ and that marine surveys or military surveys carried out by MSR platforms require the consent of the coastal State.  相似文献

Several significant international incidents in Asian exclusive economic zones (EEZs) have underscored the ambiguity and lack of agreement regarding the regime governing foreign military activities in coastal States’ EEZs. A group of senior officials and analysts participated in their personal capacities in a dialogue from 2002–2005 that discussed the issues with a view to improving mutual understanding of the regime and finding areas of agreement. The Tokyo meeting in September 2005 reached consensus on some voluntary, non-binding guidelines that are presented here. The guidelines are based selectively on the 1982 UNCLOS, State practice and emerging ‘soft’ law, and attempt to balance the interests of coastal States and user States. It is hoped that they may serve as the basis for discussion and eventual agreements between governments.  相似文献

Military intelligence gathering activities in the EEZs are becoming more controversial and more dangerous due to increasing and changing demands for technical intelligence; robust weapons and electronic warfare; and widespread development of information warfare capabilities. There is agreement that freedom of navigation and overflight should not interfere with the coastal state's right to protect and manage its EEZ resources and environment. But there is considerable disagreement on the meaning of some key 1982 UNCLOS language, the means of resolving these disagreements, or whether there is a need to do so. Each alternative approach to resolving these disagreements has its advantages and disadvantages. Needed now is a common understanding of terminology and guidelines for military and intelligence gathering activities in the EEZ. What is being proposed is regime building, a process which has its own conditions for, and constraints to, success. Foremost among the conditions for success is the recognition of the necessity of co-operation, and agreement on its form such as the SUA Convention, or ocean management, which may have a spillover effect to enhanced multilateral security. Given the constraints, a loose blueprint for the way forward can be constructed in which the continuity of this informal dialogue plays a major role. Specific next steps include fact finding regarding previous incidents; production of a glossary of definitions of critical terms; categorization of activities in the EEZ as to which are allowed and not allowed; the manner of implementation of coastal states’ rights; the means and manner of enforcement of any agreed rules; and specific suggestions for policy.  相似文献

The declining health of marine ecosystems around the world is evidence that current piecemeal governance is inadequate to successfully support healthy coastal and ocean ecosystems and sustain human uses of the ocean. One proposed solution to this problem is ecosystem-based marine spatial planning (MSP), which is a process that informs the spatial distribution of activities in the ocean so that existing and emerging uses can be maintained, use conflicts reduced, and ecosystem health and services protected and sustained for future generations. Because a key goal of ecosystem-based MSP is to maintain the delivery of ecosystem services that humans want and need, it must be based on ecological principles that articulate the scientifically recognized attributes of healthy, functioning ecosystems. These principles should be incorporated into a decision-making framework with clearly defined targets for these ecological attributes. This paper identifies ecological principles for MSP based on a synthesis of previously suggested and/or operationalized principles, along with recommendations generated by a group of twenty ecologists and marine scientists with diverse backgrounds and perspectives on MSP. The proposed four main ecological principles to guide MSP—maintaining or restoring: native species diversity, habitat diversity and heterogeneity, key species, and connectivity—and two additional guidelines, the need to account for context and uncertainty, must be explicitly taken into account in the planning process. When applied in concert with social, economic, and governance principles, these ecological principles can inform the designation and siting of ocean uses and the management of activities in the ocean to maintain or restore healthy ecosystems, allow delivery of marine ecosystem services, and ensure sustainable economic and social benefits.  相似文献

This short communication piece presents guidelines and challenges for organizing fisheries learning exchanges (FLEs). Non-governmental organizations, government agencies, and resource users use FLEs to share best practices and bridge knowledge gaps between small-scale fishing communities and stakeholder groups. Even though FLEs are widely used and have numerous cited benefits, there are challenges associated with planning and implementing FLEs. To overcome these challenges and maximize FLEs’ effectiveness, the authors describe guidelines for FLE organizers. The guidelines are based on the perspectives of over 20 FLE experts collected during 2013 through questionnaires, interviews, discussions, and surveys. The guidelines include steps that organizers should take before, during, and after a FLE. For instance, there was broad consensus that before a FLE, it is important to select a diverse group of participants, including both conservation advocates and critics, and to create an exchange agreement outlining the roles and responsibilities of participants. During a FLE, cultural activities and daily reflections by participants are valuable to the exchange process. After a FLE, activities that formalize the participants’ involvement in the FLE are important, such as welcome-home ceremonies and participation certificates. Follow-up support for FLE participants is perceived as an essential step in the FLE and should be included in the FLE's budget. Finally, challenges in organizing FLEs are explicitly described and potential solutions to overcome those challenges are provided. The authors researched and compiled these guidelines and challenges to inform and improve the increasingly widespread use of FLEs.  相似文献

Currently there is a strong interest in Cuba in improving the performance of the fisheries sector with respect to social, biological, and economic outcomes. Many important fishery resources appear to be overexploited, and previous fishery regulations have had mixed success in restoring fishery stocks. The current fishing pressure could also have adverse impacts on other valuable ecosystem services that support economic activities such as dive tourism and recreational fishing. A new State policy to expand cooperative enterprises to non-agricultural sectors provides an opportunity for fishery cooperatives to be created for the first time since the early years of the Cuban Revolution. This paper explores the potential ecological, social, and economic benefits of adopting fishery cooperatives as a co-management scheme for Cuba's marine fisheries. It concludes that well-designed fishery cooperatives can offer substantial benefits to the management of the fishery sector. Based on an analysis of the relative success of fishing cooperatives worldwide, guidelines are provided for the design of fishery cooperatives in Cuba.  相似文献

In this paper a modified electromagnetic current meter (ECM) is presented which, in contrast to the old model, permits us to perform continuous measurements of the velocity field and to acquire the data immediately in a vector form at one direction of towing of the device. To prove that the new current meter can be produced, the relationship between the recorded electric signal and the velocity field, with two transducers being towed across the areas of variable currents, is examined. Analysis of the errors allows a deduction regarding possible utilization of the modified ECM to study the horizontal variability of the current velocity field practically without any restrictions in the deep sea and with some restrictions in the continental shelf zone.Translated by V. Oil spill accidents can be caused by several risk factors associated to maritime transport and port activities, which cannot always be predicted or controlled. Therefore, it is essential to support prevention and contingency plans, whose effectiveness is crucial to produce adequate responses and minimize resulting impacts.Ria de Aveiro (Portugal) is a wide coastal lagoon, within a densely populated area, representing a concentration of important biodiversity resources and several economic activities. This paper presents alternative methodologies to support the optimization of civil protection assets in the occurrence of oil spill events and the results of their application on a section area of the Aveiro Lagoon, using an established geographic information system database containing crucial data.The presented methodologies are based on the Environmental Sensitivity Index developed by the North American National Oceanic and Atmospheric Administration (USA) and the Global Vulnerability Index which were applied on the Bay of Biscay (Spain). However, during the development of this work, neither of these methodologies was considered to entirely assess the study area in its full extent, which led to the need to adapt and define a bespoke approach. The introduced changes include extra categories in shoreline classification, an adapted physical vulnerability index for coastal lagoons, differentiated aspects for highly protected status areas, qualitative assessment of socioeconomic features and an access and operability index created to support emergency operation response.The resulting maps are the subject of analysis, in which considerations regarding control and cleanup methods are introduced, together with guidelines for further integration in local risk management strategies.  相似文献

This paper reviews differences and overlaps between hydrographic surveying and marine scientific research in the exclusive economic zone (EEZ), including the concept of military surveying. It concludes that recent trends with technology, the utility of hydrographic data and State practice suggest that hydrographic surveying in the EEZ should be under the jurisdiction of the coastal State. Paradoxically arguments for military surveys in the EEZ being outside coastal State jurisdiction appear stronger than those for hydrographic surveying. The paper offers some guidelines related to the conduct of hydrographic surveying in the EEZ.  相似文献

Community acceptance of Marine Parks is widely acknowledged as being critical for success. Where community stewardship and voluntary compliance have been achieved, there are fewer issues with non-compliance of zoning regulations. Probability-based surveys that are representative of the wider community can improve understanding of community perceptions prior to and following establishment of Marine Parks. Understanding attitudes towards newly created Marine Parks among user groups provides valuable information for the design of education and engagement programs, while also creating a benchmark to compare changes over time. A survey of community perceptions and awareness regarding the recently created Ngari Capes Marine Park in south-west Western Australia was measured via a randomised telephone survey of local and non-local boat-based recreational fishers; and local residents (including non-fishers and shore/boat fishers). This survey also evaluated other recreational uses of the park and how these activities were valued, knowledge of Marine Park zones, and how information about Marine Parks was being accessed. Participation in recreational fishing within Ngari Capes was above average and a supportive attitude towards the park was apparent. Boat-based recreational fishers displayed a higher degree of concern about fishing restrictions compared to local residents, but overall were supportive of the Marine Park. Across all user groups there was low awareness of the Ngari Capes Marine Park and poor understanding of Marine Parks. A lack of clarity regarding the likely benefits of the Ngari Capes Marine Park was apparent, implying a need to improve public communication and community engagement.  相似文献

Ecosystem-based management (EBM) has been widely accepted as the new paradigm to manage marine ecosystems. Although various efforts have been made to define key components, guidelines, and principles, in support of its implementation, there is still a gap between theory and practice. To implement EBM, managers require a decision-making framework in which the values of constituents, objectives and performance measures are consistent and used to evaluate and choose between alternatives. Structured decision-making (SDM) is a systematic approach that can contribute to develop this framework for EBM. SDM was used for the on-going EBM process on the west coast of Vancouver Island, British Columbia, Canada. This case study provides insights into how SDM can be implemented for EBM, as well as some challenges and opportunities encountered during the process.  相似文献

Substandard vessels that fail to comply with international maritime regulations are the target of Port State Control inspections. Despite their significant costs, many inspections do not lead to any detentions and, in a significant number of cases, no deficiencies are detected. In this paper, quantile regressions for count data are used to estimate the likelihood of having a high number of deficiencies of a specific type. The purpose is to complement existing practices focusing on detention with the objective to improve the selection process. Similar factors influence the likelihood of having a vessel detained and that of having a vessel recording a high number of deficiencies. However, quantile regressions applied to the number of deficiencies help improving the identification of factors influencing the likelihood of finding some specific types of deficiencies, which is the focus of Concentrated Inspection Campaigns. The paper concludes that the selection process for such campaigns should be improved using this new methodology.  相似文献

In 1999 the Marine and Marine Industries Council was established by the Tasmanian (Australia) State Government and in 2001 a Tasmanian Marine Protected Area Strategy was launched. The aims of this paper are to: investigate the views, perceptions and attitudes of commercial fishers towards this Strategy and to identify the key issues that influence fisher support or opposition to marine protected areas (MPAs). Fifty-one structured interviews with license supervisors of commercial abalone, rock lobster and scalefish fishers were conducted. Fishers stated that they would conditionally support MPAs if they sustained or increased fish populations, supported research, allowed fishing in multiple use areas, and if multiple use areas contained small ‘no-take’ zones. Fishers were concerned about the ability of the government to provide adequate marine protected area monitoring and compliance and were critical of the public consultation process that accompanied the development of the Strategy. Concern was expressed regarding the potential negative impact of additional MPAs in terms of resource sustainability and the long-term economic viability of the fishery.  相似文献

While the principle of abstention was established as part of the International North Pacific Fishery Convention in 1952, it was generally overlooked for several decades afterwards. The 1995 Straddling Stocks Agreement says that states parties to the Agreement enjoy a right to access to high seas fishery resources, but on the condition that they respect existing regional conservation and management measures. This Agreement also introduces the concept of a precautionary approach. The end result is that the 1995 Agreement fulfilled the same intent of the original 1952 principle of abstention—that is, it places some kinds of restrictions on high seas fishing. The degree of restrictions depends on the activities and policies of new regional fishery organizations like WCPFC and so on. Even if the new version of the principle of abstention succeeds in excluding distant fishing states from high seas, it will do little to solve the larger problems facing today's ocean fishery resources.  相似文献

The Maritime Labour Convention, 2006 outlines a framework for states to enforce jurisdiction over maritime labour matters, including the Flag State, Port State and Labour Supplying State. However, the Convention does not provide explicit guidance on jurisdiction determination. This article argues that seafarers should have the right to access the jurisdictions of member states, and that future amendment to the Convention should confirm this right. This paper first analyses current theories of maritime labour jurisdiction. Secondly, it conducts a comparative doctrinal analysis regarding adjudicative jurisdiction principles in common law and civil law systems. Thirdly, in three case studies involving concurrence jurisdictions of member states, this article finds that the authority of any single member state is not reliably accessible to seafarers, in particular when the state has no strong link with the seafarers. This article recommends that seafarers’ rights in the Convention to choose one jurisdiction from relevant member states should be confirmed in a future amendment.  相似文献

To understand this system in depth it is necessary to know about its origins, development and consolidation. Eradicating substandard registers calls for the application of specific directions like the ones presented, which are a result of many years of researching and working for international organizations aiming at the modernization and consolidation of some ORs. The coastal zone of the State of Campeche have some of the Gulf of Mexico’s richest ecosystems characterized by extensive seagrasses, mangrove forests, low-land tidal wetlands, a broad deltaic environment, including the Usumacinta/Laguna de Terminos estuarine ecosystem, and extensive low salinities and brackish wetlands in the Petenes region. Commercial and artisanal fishing, maritime transport, agriculture and cattle grazing in low-land areas, urban expansion, building of highways, and tourism, are important economics activities that are increasing in the State of Campeche. However, the growth needs to occur in a sustainable manner with adequate protection of the coastal ecosystems. The theoretical approach and conceptual basis of the integrated coastal management plan are based on 20 years of scientific research in the region; and from 1990 to the present, a number of projects have been completed which serve as case studies of coastal management coupling science, technology, public participation, and policymaking in the southern Gulf of Mexico. After developing seven “study case” integrating science into policymaking, a management approach was developed considering four main actions: promotion of institutional arrangements, so that the multi-sectorial planning approach be considered in coastal resources development; strengthening of public awareness related to coastal resources management policies and capabilities; gathering, analysis and dissemination of information related to coastal resources development; and provision of technical solutions to coastal resources uses in conflict. Finally this is a case study where science played a significant role in the politics of the policy process, both in protecting key estuarine ecosystem and the planning process defining the ICZM plans.  相似文献
