Abstract

The aim of this article is to discuss the international legal implications of a sector-based approach to long-term climate policy. Sector-based approaches have emerged as a possible way of engaging all the major emitters of greenhouse gases into the system. The article divides sectoral approaches into two main categories based on their legal relevance. Substantive sectoral models focus on ways of defining emission levels for global industry sectors. From the point of view of international law, substantive sectoral models could be integrated into the existing climate change regime if the Parties so agree. Procedural sectoral models focus on actors. Some procedural sectoral models envisage treaty regimes involving non-State actors, such as organizations representing global industry sectors undertaking to reduce emissions of greenhouse gases. Achieving a successful transition to a low carbon economy, in the UK and other countries, will require sufficient people with appropriate qualifications and skills to manufacture, install, and operate the low carbon technologies and approaches. The actual numbers and types of skills required are uncertain and will depend on the speed and direction of the transition pathways, but there are reasons to doubt that market mechanisms will deliver the necessary skilled workers in a timely manner. The range of market, government, and governance failures relating to the provision of low carbon skills are examined, particularly for their potential to cause a slower, costlier, and less employment-intensive transition. The potential policy responses to these failures are considered, including standardization of funding for training; formalization of transferable qualifications; legally binding targets for carbon emissions reductions and low carbon technology deployment; framework contracts and agreements between actors in key sectors; licensing and accreditation schemes for key technology sectors; government support for skills academies and training centres; support for first movers in niches; increasing mobility of workers; and providing a clear long-term cross-sectoral framework for a low carbon transition, including skills training.

Policy relevance

The article argues for the importance of skills issues for a successful transition to a low carbon economy. It outlines the potential causes of skills shortages, both generic and those specific to low carbon, as well as the probable impact of these types of shortages. By changing existing sectoral and occupational patterns, the transition will disrupt the existing market and government mechanisms to identify and remedy skills shortages in specific sectors. The nature and required pace of the low carbon transition also means that there are pressures that could induce greater skills shortages. These shortages, in turn, could critically delay elements of the transition and increase its cost and duration. The article outlines approaches taken to address these causes of skills shortages, drawing on examples from UK low carbon policy. The article ends with an argument that skills issues need to be more central to transitions debates.  相似文献

Although a global cap-and-trade system is seen by many researchers as the most cost-efficient solution to reduce greenhouse gas (GHG) emissions, the governments of developing countries refuse to enter into such a system in the short term. Many scholars and stakeholders, including the European Commission, have thus proposed various types of commitments for developing countries that appear less stringent, such as sectoral approaches. A macroeconomic assessment of such a sectoral approach is provided for developing countries. Two policy scenarios in particular are assessed, in which developed countries continue with Kyoto-type absolute commitments, while developing countries adopt an emissions trading system limited to electricity generation and linked to developed countries' cap-and-trade systems. In the first scenario, CO2 allowances are auctioned by the government, which distributes its revenues as a lump sum to households. In a second scenario, the auction revenues are used to reduce taxes on, or to give subsidies to, electricity generation. The quantitative analysis, conducted with a hybrid general equilibrium model, shows that such options provide almost as much emissions reduction as a global cap-and-trade system. Moreover, in the second sectoral scenario, GDP losses in developing countries are much lower than with a global cap-and-trade system, as is also the effect on the electricity price.  相似文献

Emissions from the production of iron and steel could constitute a significant share of a 2°C global emissions budget (around 19% under the IEA 2DS scenario). They need to be reduced, and this could be difficult under nationally based climate policy approaches. We compare a new set of nationally based modelling (the Deep Decarbonization Pathways Project) with best practice and technical limit benchmarks for iron and steel and cement emissions. We find that 2050 emissions from iron and steel and cement production represent an average 0.28?tCO2 per capita in nationally based modelling results, very close to the technical limit benchmark of 0.21?tCO2 per capita, and over 2.5 times lower than the best practice benchmark of 0.72?tCO2 per capita. This suggests that national projections may be overly optimistic about achievable emissions reductions in the absence of global carbon pricing and an international research and development effort to develop low emissions technologies for emissions-intensive products. We also find that equal per capita emissions targets, often the basis of proposals for how global emissions budgets should be allocated, would be inadequate without global emissions trading. These results show that a nationally based global climate policy framework, as has been confirmed in the Paris Agreement, could lead to risks of overshooting global emissions targets for some countries and carbon leakage. Tailored approaches such as border taxes, sectoral emissions trading or carbon taxes, and consumption-based carbon pricing can help, but each faces difficulties. Ultimately, global efforts are needed to improve technology and material efficiency in emissions-intensive commodities manufacturing and use. Those efforts could be supported by technology standards and a globally coordinated R&D effort, and strengthened by the adoption of global emissions budgets for emissions-intensive traded goods.

Policy relevance

This article presents new empirical findings on global iron and steel and cement production in a low-carbon world economy, demonstrates the risks associated with a nationally based global climate policy framework as has been confirmed in the Paris Agreement, and analyses policy options to deal with those risks.  相似文献

A sectoral approach to GHG emissions reductions in developing countries is proposed as a key component of the post-2012 climate change mitigation framework. In this approach, the ten highest-emitting developing countries in the electricity and other major industrial sectors pledge to meet voluntary, ‘no-lose’ GHG emissions targets in these sectors. No penalties are incurred for failing to meet a target, but emissions reductions achieved beyond the target level earn emissions reduction credits (ERCs) that can be sold to industrialized nations. Participating developing countries establish initial ‘no-lose’ emissions targets, based upon their national circumstances, from sector-specific energyintensity benchmarks that have been developed by independent experts. Industrialized nations then offer incentives for the developing countries to adopt more stringent emissions targets through a ‘Technology Finance and Assistance Package’, which helps to overcome financial and other barriers to technology transfer and deployment. These sectorspecific energy-intensity benchmarks could also serve as a means for establishing national economy-wide targets in developed countries in the post-2012 regime. Preliminary modelling of a hybrid scenario, in which Annex I countries adopt economy-wide absolute GHG emissions targets and high-emitting developing countries adopt ‘no-lose’ sectoral targets, indicates that such an approach significantly improves the likelihood that atmospheric concentrations of CO2 can be stabilized at 450 ppmv by the end of the century.  相似文献

This article assesses a wide range of alternative proposals for post-2012 international climate policy regimes. We believe that these proposals will serve as a basis for debates about how to configure post-2012 climate policy. The article characterizes and assesses the policy proposals along the lines of five key policy dilemmas. We argue that (1) many proposals have ideas on how to reduce emissions, but fewer have a solution on how to stimulate technical innovation; (2) many proposals formulate climate policy in isolation, while there are fewer proposals that try to mainstream climate policies in other policy areas; (3) many proposals advocate market-based solutions, while fewer realize that there are certain drawbacks to this solution especially at the international level; (4) most proposals have a preference for a UN-based regime, while a more fragmented regime, based on regional and sectoral arrangements may be emerging; and (5) most proposals have ideas about mitigation, but not many have creative ideas on how to integrate mitigation with adaptation.  相似文献

This paper presents a new sector-based framework — called the multi-sector convergence approach — for negotiating binding national GHG mitigation targets after the first budget period defined by the Kyoto Protocol (2008–2012). The major characteristics of this approach are that: (i) it is based on the distinction of different sectors within the national economy; (ii) it prescribes that, in principle, the amount of per capita emission assignments should ultimately converge to the same level for all countries; (iii) it accounts for differences in national circumstances by offering the opportunity to grant additional emission allowances to countries facing specific circumstances that justify higher emission assignments; and (iv) it offers a framework for negotiating mitigation commitments among parties of the UNFCCC, including a (gradual) participation of developing countries that pass a certain threshold level of per capita emissions. In addition to briefly discussing the underlying principles of promising proposals to differentiate future GHG mitigation commitments, the paper outlines the methodology and major characteristics of the multi-sector convergence (MSC) approach, followed by some numerical illustrations. Globally, agriculture and related land use change contributed about 17% of the world’s anthropogenic GHG emissions in 2010 (8.4 GtCO2e yr?1), making GHG mitigation in the agriculture sector critical to meeting the Paris Agreement’s 2°C goal. This article proposes a range of country-level targets for mitigation of agricultural emissions by allocating a global target according to five approaches to effort-sharing for climate change mitigation: responsibility, capability, equality, responsibility-capability-need and equal cumulative per capita emissions. Allocating mitigation targets according to responsibility for total historical emissions or capability to mitigate assigned large targets for agricultural emission reductions to North America, Europe and China. Targets based on responsibility for historical agricultural emissions resulted in a relatively even distribution of targets among countries and regions. Meanwhile, targets based on equal future agricultural emissions per capita or equal per capita cumulative emissions assigned very large mitigation targets to countries with large agricultural economies, while allowing some densely populated countries to increase agricultural emissions. There is no single ‘correct’ framework for allocating a global mitigation goal. Instead, using these approaches as a set provides a transparent, scientific basis for countries to inform and help assess the significance of their commitments to reducing emissions from the agriculture sector.

Key policy insights
  • Meeting the Paris Agreement 2°C goal will require global mitigation of agricultural non-CO2 emissions of approximately 1 GtCO2e yr?1 by 2030.

  • Allocating this 1 GtCO2e yr?1 according to various effort-sharing approaches, it is found that countries will need to mitigate agricultural business-as-usual emissions in 2030 by a median of 10%. Targets vary widely with criteria used for allocation.

  • The targets calculated here are in line with the ambition of the few countries (primarily in Africa) that included mitigation targets for the agriculture sector in their (Intended) Nationally Determined Contributions.

International carbon markets can be an important tool in achieving countries’ mitigation targets under the Paris Agreement, but they are subject to a number of environmental integrity risks. An important risk is that some countries have mitigation targets that correspond to higher levels of emissions than independent projections of their likely emissions. If such ‘hot air’ can be transferred to other countries, it could increase aggregated emissions and create a perverse incentive for countries not to enhance the ambition of future mitigation targets. Limits to international transfers of mitigation outcomes have been proposed to address this risk. This article proposes a typology for such limits, explores key design options, and tests different types of limits in the context of 15 countries. Our analysis indicates that limits to international transfers could, if designed appropriately, prevent most of the hot air contained in current mitigation targets from being transferred, but also involve trade-offs between different policy objectives. Given the risks from international transfer of hot air and the uncertainty over whether other approaches will be effective in ensuring environmental integrity, we recommend that countries take a cautious approach and pursue a portfolio of approaches to ensure environmental integrity, in which case limits could provide for additional safeguards.

Key policy insights

  • Limits to international transfers involve trade-offs between different policy objectives, in particular reducing the risk that countries transfer hot air and enabling participation in carbon markets.

  • Under ‘relative’ limits a country may transfer mitigation outcomes to the extent that its actual emissions are below the limit. Relative limits derived from historical emissions data have significant limitations, and none of the tested approaches was found to be effective for all countries. Relative limits based on emission projections could be a more valid approach, although they are also technically and politically challenging.

  • Under ‘absolute’ limits a country could only issue, transfer or acquire a certain amount of mitigation outcomes. Absolute limits set at sufficiently low levels could prevent countries from transferring large amounts of hot air, but are bluntly applicable to all countries, whether or not they have hot air.

Methane emissions from livestock enteric fermentation and manure management represent about 40% of total anthropogenic greenhouse gas emissions from the agriculture sector and are projected to increase substantially in the coming decades, with most of the growth occurring in non-Annex 1 countries. To mitigate livestock methane, incentive policies based on producer-level emissions are generally not feasible because of high administrative costs and producer transaction costs. In contrast, incentive policies based on sectoral emissions are likely administratively feasible, even in developing countries. This study uses an economic model of global agriculture to estimate the effects of two sectoral mitigation policies: a carbon tax and an emissions trading scheme based on average national methane emissions per unit of commodity. The analysis shows how the composition and location of livestock production and emissions change in response to the policies. Results illustrate the importance of global mitigation efforts: when policies are limited to Annex 1 countries, increased methane emissions in non-Annex 1 countries offset approximately two-thirds of Annex 1 emissions reductions. While non-Annex 1 countries face substantial disincentives to enacting domestic carbon taxes, developing countries could benefit from participating in a global sectoral emissions trading scheme. We illustrate one scheme in which non-Annex 1 countries collectively earn USD 2.4 billion annually from methane emission permit sales when methane is priced at USD 30/t CO2-eq.  相似文献

One of the most fundamental questions surrounding the new Paris Agreement is whether countries’ proposals to reduce GHG emissions after 2020 are equally ambitious, considering differences in circumstances between countries. We review a variety of approaches to assess the ambition of the GHG emission reduction proposals by countries. The approaches are applied illustratively to the mitigation part of the post-2020 climate proposals (nationally determined contributions, or NDCs) by China, the EU, and the US. The analysis reveals several clear trends, even though the results differ per individual assessment approach. We recommend that such a comprehensive ambition assessment framework, employing a large variety of approaches, is used in the future to capture a wide spectrum of perspectives on ambition.

POLICY RELEVANCE

Assessing the ambition of the national climate proposals is particularly important as the Paris Agreement asks for regular reviews of national contributions, keeping in mind that countries raise their ambition over time. Such an assessment will be an important part of the regular global stocktake that will take place every five years, starting with a ‘light’ version in 2018. However, comprehensive methods to assess the proposals are lacking. This article provides such a comprehensive assessment framework.  相似文献

In particular, uncertainties over market prices and trading eligibility, coupled with the costs of participation, may together be the Achilles heel of some allocation proposals that entail large financial transfers from industrialized to developing countries. Any proposal for an ‘equitable’ allocation of emission allowances, we conclude, must be cognizant of the risks and costs implied by a reliance on international emissions trading. Climate change mitigation is a wicked problem that cuts horizontally across sectors and vertically across levels of government. To address it effectively, governments around the world, in particular in the EU, have developed several generations of multi-sectoral national mitigation strategies (NMS) since the early 1990s. Although NMS became the main effort to systematically coordinate mitigation policies, few works have studied them comparatively so far. The present article fills this gap by analysing how the EU-15 group of countries operationalized climate protection through NMS. First, we introduce the three roles policy strategies usually aim to fulfil: besides being policy documents they also represent governance processes (supposed to coordinate sectoral implementation), and capacity-building efforts. Empirically, we then explore the rationale, origins and prevalence of NMS. Subsequently, we characterize them as policy documents (with regards to their contents and structures) and as governance processes that address capacity building only implicitly. Based on existing assessments we finally review some performance indications of NMS. We find that in particular second- and third-generation NMS aimed to take their governance function seriously but resembled ‘lacklustre bookkeeping' of emissions, targets and mitigation options. Instead of approximating NMS towards their obviously overcharging governance function, we suggest to recalibrate them towards their communication and capacity-building function in a way that goes beyond bookkeeping.

Policy relevance

The present article shows that NMS fail to effectively govern climate change mitigation across a broad range of sectoral policy domains. Since most European countries have adopted not one but up to three generations of NMS since the 1990s, this finding is highly relevant for them – and for all others aiming to adopt similarly broad strategies. Instead of piling one strategy on top of another irrespective of their implementation, and instead of abolishing mitigation strategies altogether, we recommend recalibrating them towards what they can realistically accomplish: effective communication and capacity building so that NMS can advance from lacklustre bookkeeping to actively promoting a government-wide climate change mitigation vision. The article can help governments to realise that renewing integrated strategies such as NMS without overhauling them comes close to flogging a dead horse.  相似文献

Global GHG emissions continue to rise, with nearly a quarter of it due to trade that is not currently captured within global climate policy. In the context of current trade patterns and limited global cooperation on climate change, the feasibility of consumption-based emissions accounting to contribute to a more comprehensive (national) policy framework in the UK is investigated. Consumption-based emissions results for the UK from a range of models are presented, their technical robustness is assessed, and their potential application in national climate policy is examined using examples of policies designed to reduce carbon leakage and to address high levels of consumption. It is shown that there is a need to include consumption-based emissions as a complementary indicator to the current approach of measuring territorial emissions. Methods are shown to be robust enough to measure progress on climate change and develop and inform mitigation policy. Finally, some suggestions are made for future policy-oriented research in the area of consumption-based accounting that will facilitate its application to policy.

Policy relevance

Emissions embodied in trade are rapidly increasing and there is thus a growing gap between production emissions and the emissions associated with consumption. This is a growing concern due to the absence of a global cap and significant variation in country-level mitigation ambitions. Robust measurements of consumption-based emissions are possible and provide new insights into policy options. This includes trade-related policy (e.g. border carbon adjustments) and domestic policies (e.g. resource efficiency strategies). As climate policy targets deepen, there is a need for a broad range of policy options in addition to production and technological solutions. Consumption-based emissions are complementary to production-based emissions inventories, which are still the most accurate estimate for aggregated emissions at the global level. However, without consumption-based approaches, territorial emissions alone will not provide a complete picture of progress in regional and national emissions reduction.  相似文献

Various climate protocol proposals oblige different industrialized countries to reduce CO2 and other greenhouse gas emissions. In principle, the total costs of these obligations could be substantially reduced if emission reductions are implemented in regions with low marginal costs for CO2 reduction. This has been difficult to quantify because of lack of models with suitable regional and sectoral detail. In this paper we perform these calculations by taking advantage of the capability of the IMAGE 2 model to compute regional emissions and costs. Two main options are examined for allocating emission reductions required of industrialized regions in a cost effective manner: (1) allocating them among industrialized regions (2) allocating them among all world regions. The cost savings for each of these options are presented. The main conclusions are that (a) it is of great importance for the cost comparisons of protocols to use a well defined baseline scenario and clearly formulated targets, and (b) large economic benefits, in the order of 35–65%, can accrue from joint-implementation agreements which allocate investments on the basis of net marginal costs of CO2 emission reduction.  相似文献
