| 摘 要： | 由于黄河三角洲不合理、盲目开发与整治,黄河三角洲湿地生态系统遭受严重破坏。黄河三角洲保护的法规尚不完善,现行政策对实践的指导性差,生态系统管理受制于行政职权的划分。有鉴于此,提出完善黄河三角洲生态保护政策、法制的建议:完善黄河三角洲生态保护立法;贯彻生态系统管理思想,厘清行政管理关系;生态补偿制度法律化;试点环境公益诉讼。

| Abstract: | Unreasonable and blind exploitation on the wetlands has led to severe damages to wetland ecosystems in Yellow River Delta.The laws and regulations for protecting Yellow River delta are still imperfect,and current policies provide poor guidance to the practices.Ecosystem management is constrained within fragmented administrative responsibilities.Recommendations were made to improve policies and laws for ecological protection in Yellow River Delta,improving the legislation for ecological protection in Yellow River Delta,implementing the concept of ecosystem management,clarifying administrative responsibilities of different governmental departments,legalization of ecological compensation system and carrying out pilot law suit for environmental public interest litigation. |
