China and Vietnam have recently signed two bilateral agreements to deal with maritime issues in Beibu Gulf. One is the maritime boundary delimitation agreement, and the other the fisheries agreement. The two parties have also formulated a supplementary protocol to the latter agreement. All of them have entered into force on 30 June 2004. This article introduces the new arrangements for fisheries management initiated by the two countries, focusing especially on the Joint Fishery Committee established by the two parties, the contracting waters covered by the fisheries agreement, and the conservation and management measures for the Gulf's fisheries. The challenges likely confronted by China after this institutional change takes place are analyzed. A brief comparison is drawn among the three effectual fisheries agreements signed by China, respectively, with Japan, South Korea and Vietnam. Finally, as for the future of fisheries management in the Gulf some recommendations are made.  相似文献

Taiwan and China have a long history of sharing marine resources in the China Seas. However, due to political issues, the two sides have yet to formalize collaboration and interaction despite such a close geographical relationship. The lack of formal collaboration means they cannot manage fisheries or conserve resources as a team. The lack of collaboration in the regional fisheries management organizations also means a mutually beneficial situation for the two sides is yet to be achieved. Recognizing this, the two sides began negotiations in 2008 and have since signed agreements on fisheries co-operation projects. This paper discusses the unique fisheries relationship between Taiwan and China, and the characteristics of their fishing industries. The paper also presents the latest update on the collaboration between the two sides. Finally, this paper proposes practical solutions for resolving outstanding issues between the two sides’ fishing industries.  相似文献

The purpose of this paper is to analyse the relationship of the proposed new UNCLOS Implementing Agreement concerning the conservation and sustainable use of marine biological diversity of areas beyond national jurisdiction with the current legal framework concerning fisheries. It elaborates on selected elements that are under negotiations, namely: marine genetic resources, area-based management tools, including marine protected areas, as well as environmental impact assessments. Each of those elements is analyzed with particular emphasis being laid on the following issues. Firstly, how the current legal status quo in the relevant area looks like. Secondly, how the question of fisheries could be included in a future treaty and, thirdly, what bearing it could have on the current framework of the management of fisheries.The article concludes with the identification of possible fields where the new treaty could bring added value. However, some possible challenges are mentioned as well. They relate in particular to the fact that the mandate of negotiations underscores that they shall not ‘undermine existing legal instruments and frameworks and relevant global, regional and sectoral bodies’.  相似文献

This paper provides an overview of the small-scale fisheries sector in countries within the Benguela Current Large Marine Ecosystem (BCLME), one of the most productive large marine ecosystems in the world. The study revealed that Angola, Namibia and South Africa have very different legal and policy frameworks, show different levels of compliance with international and regional agreements to protect the livelihoods and food security of small-scale fishers, as well as of integration of fisheries into food security objectives. Angolan law recognises and protects small-scale fishers through legal and institutional mechanisms. In Namibia, this sector of fishers is not legally recognised, while in South Africa traditional fishers have been largely excluded from the new fisheries management framework. Trends in national and regional fish consumption and in the extent of export orientation in fisheries are explored, as well as the potential threats to small-scale producers and food security in the region posed by ongoing drives to incorporate fisheries in the World Trade Organisation (WTO) agreements.  相似文献

Successful species conservation typically results in conflicts between wildlife protection and economic uses of natural resources as in fisheries and aquaculture. This article shows why managing these conflicts require a more comprehensive approach than currently pursued by endangered species conservation programmes. Against the background of several case studies focussing on wildlife conflicts in European waters this article derives two challenges for institutional response: First, the question of mandate—which societal actor initiates management related processes that require multiple actors to collaborate? This article examines China's distant water fishing industry, with a focus on China's bilateral fisheries access agreements in Africa. The article argues that China largely conforms to international norms and rules on sustainable fisheries, but that challenges remain in efforts to work with China on the sustainable management of fish stocks. In March 1996, China fired missiles near Taiwan’s two largest ports, namely, Keelung in the north and Kaohsiung in the south. The event disrupted sea and air transport in the area and was considered as a ‘partial blockade’ of Taiwan. China’s missile tests conducted in the waters of the Taiwan Strait give rise to several international law questions, such as: did China’s missile tests amount to a blockade of Taiwan and accordingly are subject to the international law of blockade: and does China, as a member of the United Nations, have the right, under international law, to fire missiles across the Taiwan Strait to intimidate Taiwan. This paper addresses these legal issues. This paper concludes by suggesting that China’s missile tests, in legal terms, did not amount to a blockade, but a military operation at sea, and that China failed to pass the reasonableness test for justifying its missile tests on the high seas and, thus, could be seen as in violation of international law. However, a caveat is given in the conclusion, that is, the legality of China’s missile tests in the waters so close to Taiwan’s coasts cannot but be appraised in the context of how other members of the international community view Taiwan’s legal status and the position they take regarding whether the Taiwan question is indeed entirely an internal matter of China.  相似文献

As increasingly large extents of the global oceans are being managed through spatial measures, it is important to identify area characteristics underlying network distributions. Studies discerning spatial patterns in marine management have disproportionately focused on global networks. This paper instead considers the single country context of Japan to illuminate within-country drivers of area-based conservation and fishery management. A dataset containing potentially relevant socioeconomic, environmental, and fisheries factors was assembled and used to model prefecture-level counts of marine protected areas (MPAs) and territorial use rights for fisheries (TURFs) throughout Japan's waters. Several factors were found to significantly influence the number of TURFs in a particular area, whereas MPA patterns of use remain largely unexplained. TURFs are frequently noted as more suitable for managing fisheries of low mobility species and our analysis finds greater use of TURFs in areas that rely heavily on benthic catch. The number of trading ports was also found to be positively related to TURF distributions, suggesting economic infrastructure may influence the use of this fisheries management tool. In-line with global analyses, MPA patterns of use were not found to be significantly related to any of the potential explanatory variables after correcting for the number of statistical comparisons that were carried out. Differences in our ability to model the use of TURFs and MPAs may arise due to the narrower objectives associated with the former (e.g., income, employment) in comparison to the often broad and varied goals that motivate use of the latter.  相似文献

Social-ecological complexity challenges conservation-oriented interventions even in settings with a small number of actors and conflicts involved. This article examines the development and trajectory of King and Snow Crab fisheries in the Cape Horn Biosphere Reserve (BR), the highly remote but globally connected Southern tip of the Americas. The feasibility of the Chilean legal instrument of Marine Management Areas (MMA) is assessed as a tool for mitigating impacts of overfishing in the area. Examining the local fishers’ perspectives in complement to a context analysis we find that external management models such as the MMA are not suited to make Cape Horn fisheries sustainable. Instead, efforts should be dedicated to a continuous process of stakeholder collaboration for developing site-specific management concepts and structures. These should be embedded in the larger BR initiative. Considering the area's particular conditions, several recommendations for such a process are formulated.  相似文献

By reviewing the history of fishery exploitation in the coastal waters of west Canada and east Korea, related with contrasting life history strategies of the dominant species, the fishery management challenges that each country would face in the upcoming decades were outlined. In the ecosystem of the Canadian western coastal waters, the dominant oceanographic feature is the coastal upwelling domain off the west coast of Vancouver Island, the northernmost extent of the California Current System in the eastern North Pacific. In the marine ecosystem of the eastern coasts of Korea (the Japan/East Sea), a major oceanographic feature is the Tsushima Warm Current, a branch of the Kuroshio Current in the western North Pacific. Fishes in the Canadian ecosystem are dominated by demersal, long-lived species such as flatfish, rockfish, sablefish, and halibut. During summer, migratory pelagic species such as Pacific hake, Pacific salmon, and recently Pacific sardine, move into this area to feed. In the late 1970s, Canada declared jurisdiction for 200 miles from their coastline, and major fisheries species in Canadian waters have been managed with a quota system. The overall fishing intensity off the west coast of Vancouver Island has been relatively moderate compared to Korean waters. Fishes in the ecosystem of the eastern Korean waters are dominated by short-lived pelagic and demersal fish. Historically, Korea has shared marine resources in this area with neighbouring countries, but stock assessments and quotas have only recently (since the late-1990s) been implemented for some major species. In the Korean ecosystem, fisheries can be described as intensive, and many stocks have been rated as overfished. The two ecosystems responded differently to climate impacts such as regime shifts under different exploitation histories. In the future, both countries will face the challenge of global warming and subsequent impacts on ecosystems, necessitating developing adaptive fisheries management plans. The challenges will be contrasting for the two countries: Canada will need to conserve fish populations, while Korea will need to focus on rebuilding depleted fish populations.  相似文献

Carbon capture and storage (CCS) is one method to reduce CO2 emissions to the atmosphere. As CCS has the greatest potential for greenhouse gas (GHG) emission reduction, it gains a wide currency in the developed countries. However, the technology for CCS does not spread at the international level especially to the developing countries like South China Sea states. As the CO2 storage period is quite long and potential environmental risks involved, fully deployed CCS projects need not only the technological support but the appropriate legal and regulatory regime to safeguard CCS operations. This article offers a survey of CCS projects in the South China Sea region and discusses the legal challenges associated with CCS activities in state practice.  相似文献

The state of many fisheries and fishery resources requires a major change in development and management policies and strategies, at national and regional levels. The international Code of Conduct for Responsible Fisheries, adopted in FAO in 1995, provides the operational framework for such change, in all fisheries, in the oceans, inland waters, EEZs, international waters, as well as in aquaculture. In their respective areas of competence and in close collaboration, FAO and the World Bank are committed to facilitate the implementation of the Code by fishing and coastal nations. This paper presents the strategy they have developed for the purpose. The paper elaborates on: (1) the main policy-related issues faced by fisheries worldwide (bio-ecological, technological, economic, socio-cultural, institutional and legal, as well as scientific); (2) the Code of Conduct, its background, structure and scope; (3) the basis of the implementation strategy by FAO and the Bank; and the main types of activities involved at global, regional and national levels. In conclusion it describes briefly the main elements of changes imbedded in the strategy and shows that the implementation by FAO and the Bank as well as by the countries has already actively started.  相似文献

Biological diversity, or biodiversity, is high on the international agenda for nature conservation. Marine and coastal ecosystems account for an important share of the biological diversity on Earth. As a consequence many international conventions, European legislation and national laws refer to marine biodiversity. The protection of marine biodiversity is a complex legal issue as it requires consideration of geographic (between land and sea), political (between conservation and exploitation), and economic (between fisheries, tourism, intellectual property and many other sectors) factors. Like Matryoshka dolls, marine biodiversity is a heterogeneous notion difficult to address as one discrete area in the development of policy agendas or juridical frameworks. In the past decade, the EU has been very active in Promoting Integrated Coastal Zone Management and in developing a framework for an Integrated Maritime Policy. This article reviews the status of marine biodiversity in the policy and legal initiatives of the European Union, a challenging issue to both the objectives of conservation and to the concept of integration.  相似文献

Madagascar, the world's fourth largest island, is one of the world's poorest developing countries, and its people depend heavily on marine resources for subsistence and income. Exports of these resources and foreign fishing access agreements are also important, at least from a large-scale economic perspective. In recent years, concerns have been voiced amongst local fishers and industry groups regarding the growth of the country's fishing effort. Despite these concerns, existing knowledge of the scale, composition and trends of Malagasy fisheries remains poor, and there is negligible information regarding unreported catches and illegal fishing in Madagascar's waters. Small-scale fisheries, which are often substantial in developing countries such as Madagascar, are often unreported or underestimated. Unfortunately, fisheries legislations, management plans and foreign fishing access agreements are often influenced by these incomplete data, leading to serious over-estimations of resource availability. This also appears to be the situation in Madagascar, where the reconstruction of total catches by all Malagasy fisheries sectors conducted here showed that total catches between 1950 and 2008 were twice the volume reported by national fisheries agencies. Most importantly, much of the subsistence sector is missing from official statistics, and signs of decline have already been observed in several stocks, suggesting that current levels of catches are likely to be exceeding sustainable yields. This has profound implications for the economic and ecological sustainability of fisheries, as well as food security in a country where people rely heavily on the ocean for their daily protein needs and livelihoods.  相似文献

Over the past two decades profound changes have taken place in the European Union's (EU) fisheries policy. Partly these changes have occurred within the EU's Common Fisheries Policy itself, but partly policy change has been effected by the application of environmental legislation and policy instruments to fisheries issues. This article argues that the process of policy change in EU fisheries policy can best be understood in terms of the interaction of policy images and policy venues that is at the core of the punctuated equilibrium theory of policy-making. As a result of the rise of a biodiversity perspective on fisheries issues, environmental policy-makers have become active in fisheries issues, which has led to profound changes in both the content of fisheries policies and the institutional organisation around this issue area.  相似文献

Ten European fish stocks recognised by the European Union as “outside safe biological limits” are considered in light of widespread reforms to fisheries legislation in 2013, particularly the legal responsibility to exploit these resources sustainably. Given that some of these stocks are – as of 2013 – fished at over 150% the recommended intensity and many have been outside of these limits for the entirety of their assessment history, the utilisation of traditional fisheries management measures of sustainability are questioned and tougher approaches such as “zero-catch” and long-term, expansive spatial closure scenarios are considered. Finally, the pervasive issue of data-deficiency (the status of 54% of European stocks) is briefly considered, with specific reference to the understudied West of Scotland and North Sea stock of European seabass (Dicentrarchus labrax).  相似文献

Spatial boundaries have become an indispensable part of regimes and tools for regulating fisheries, with examples including marine protected areas, regional fisheries management organizations and Exclusive Economic Zones. Yet, it is also widely acknowledged that boundaries are a social construct, which may be resisted by both fishers and fish ecology. The ensuing spatial and institutional mismatches have been shown to frustrate management efforts, exacerbating issues of non-compliance and ultimately leading to conflicts and overfishing. Interestingly, the often static and rigid nature of these boundaries has also led to a concomitant research interest in ‘transboundary’. This paradoxical situation of more boundary-setting entailing more transboundary thinking warrants a deeper understanding about boundaries and the role of transboundary research in fisheries. The aims of this review article are twofold: (1) a theoretical clarification on the meanings and uses of spatial boundaries drawing on geographical “boundary studies” literature; and (2) a construction of a typology that outlines how transboundary research is being articulated and envisioned. Together, the study reveals that transboundary scholarship in fisheries are mostly related to resources, fleets, trade and governance aspects and that dealing with the “boundary paradox” encompasses re-incorporating, re-scaling and re-imagining of boundaries. This article provides a conceptual basis for reflecting upon boundaries in world's fisheries and opens up discussions for a more nuanced boundary application that can better cope with multi-level interactions and dynamicity.  相似文献

In this article, we analyze a change in the role of federal institutions in charge of managing Mexican fisheries during the mid-1990s. During 30 years, the fishery policy in Mexico began by promoting an accelerated fishing effort. This worked through 1981, when the country recorded its highest landings (1.6 million metric tons), but landings have not increased subsequently whereas the number of fishermen has continued to increase. In 1995, the federal administration acknowledged the problems: biological over-exploitation; over-capitalization; monopoly in commercialization; failures in loan payments; failures in controlling effort; obsolete vessels and equipment; and social conflicts for the resources. In an attempt to resolve some of these problems, the administration implemented structural changes in management, science and enforcement institutions. This arrangement established goals and introduced instruments in fisheries management: it determined the biological status of most of the fisheries; applied the precautionary approach for those fully exploited or over-exploited fisheries; gave scientific advice an important role in decision making; and involved the users in decision making. This article evaluates these changes in management policy by document review, participation and interviewing management and scientists who participated in this process. We analyze, in particular, the use of science-based categorization of fisheries status, and the introduction of public participation. The interview data demonstrate that sustainable Mexican fisheries require an evolution to a more public participatory policy, in order to strengthen local institutions and fishermen over federal institutions, which should lead to a re-definition of regulation of fisheries resources.  相似文献
