The Magnuson–Stevens Act is the United States׳ premier law governing fisheries conservation and management. Congress has revisited the Act multiple times since its inception in 1976—most recently in 1996 with the Sustainable Fisheries Act and in 2006 with the Magnuson Stevens Act—and is currently in the process of reauthorizing the Act. The University of Washington focused the 14th annual Bevan Series on Sustainable Fisheries on issues surrounding reauthorization. The symposium featured a diversity of stakeholders, including fisheries scientists, managers, policy analysts, students, non-governmental organizations, Tribes, and industry. The symposium explored the Act׳s history, means of ending overfishing and ensuring accountability, lessons from U.S. West Coast and North Pacific fisheries, and challenges and solutions to ecosystem-based fisheries management.  相似文献

The Magnuson-Stevens Fishery Conservation and Management Act (1976), opened a new era of federal fishery management in the United States. It was enacted primarily to establish a system for conserving and managing fisheries in the new 200-mile (EEZ). The US assumed exclusive authority for managing all fisheries within the EEZ, except for highly migratory species such as tunas and billfishes. Within the framework of the Act, eight Regional Fishery Management Councils (Regional Councils) were created, which are responsible for preparing Fisheries Management Plans (FMPs) in federal waters under their jurisdiction. Each FMP must meet a series of National Standards (NSs) for conservation and management. The Act was reauthorized in 1996 with the passage of the Sustainable Fisheries Act (SFA), which aimed at fine tuning the fishery regulatory apparatus that was established under the original Act. This "fine tuning" involved increased attention to biological concerns, and removal of ambiguities within it. The Act was reauthorized again in 2007, mainly to provide for more clear directives and regulations to end overfishing. After more than thirty years since the Act was passed into law, the debate among conservationists, commercial and recreational fishery representatives, and politicians on the effectiveness of the Act in achieving its purported goals it still continues. Is the Act delivering on its promises? Do NSs reflect the most important priorities for the US fishery resources, conservation and sustainable exploitation? Do the Regional Councils represent all parties that should be involved in the fisheries resources management? The aim of this paper is to provide a critical analysis to answer these questions. This paper begins with a review of the Act and its background, followed by discussion and analysis of the Act's benefits and flaws. Finally, suggestions for the implementation of its structure and future directions in fishery management strategies are made.  相似文献

The main objectives of fisheries management are generally similar throughout the world. These are often stated in policy documents such as the Common Fisheries Policy and the Magnuson–Stevens Fishery Conservation and Management Act. However, at the local level often the key objectives of management are more detailed, characterised by both the overriding management structure and the status and type of fishery concerned. In this paper, we consider case study fisheries from the UK, France, Spain and Denmark to compare some of the various types of fisheries and fisheries management systems that exist in the European Union. The present paper presents the practical implementation of the Ecosystem Approach to Fisheries Management (EAFM) in Norway. This involves defining management objectives and developing simple and efficient tools to achieve an overview of management needs and prioritise among these, while integrating broader conservation issues and ensuring stakeholder involvement. A new Marine Resources Act entered into force in Norway in 2009. By integrating conservation and sustainable use as basic principles, the law represents a paradigm shift in the management of Norwegian fisheries. The law indicates which concerns should be addressed, but neither how nor how often evaluations should take place. That is for management to decide. A management principle in the Marine Resources Act confers on the Ministry an obligation to evaluate whether continued fishing at the present scale is justifiable, or whether improved management is required to ensure sustainability. A Stock table, and a table of "Catches of data-poor species" constitute a comprehensive system for monitoring the management principle. Along with a Fisheries table, these tables establish a framework for developing an ecosystem-based fisheries management by providing a basis and tools for prioritising the needs of new and/or revised management measures.  相似文献

Management of the commons for biodiversity: lessons from the North Pacific   总被引:1,自引:0,他引:1  
The North Pacific has the world's largest groundfish fisheries, with a value in excess of $1 billion annually. The North Pacific also is home to the largest population of Steller sea lions (SSL), an ancient species that is now endangered. Decline of the western stock of SSL in the 1970–1990s coincided with the US nationalization and exponential growth in the Gulf of Alaska and Bering Sea/Aleutian Islands groundfish fishery.The article treats five aspects of the competition between the fishery and protection of the endangered species. First, we analyze competition of interests in the use, management, and preservation of the North Pacific commons, including offshore and near-shore fisheries, environmental organizations, governments (federal, state, and local), and the scientific community. Second, the article compares and contrasts provisions of the National Environmental Policy Act, the Marine Mammal Protection Act, the Endangered Species Act, and the Magnuson–Stevens Act (as amended in 1996 by the Sustainable Fisheries Act).Third, we examine the regulatory environment with a focus on the National Marine Fisheries Service (NMFS) and its relationship to the North Pacific Fishery Management Council. We illustrate how NMFS establishes fishery management plans and the methods, such as crafting biological opinions and environmental-impact-statements, it uses to resolve conflicts. Fourth, we investigate how the dual pressures on the agency—to increase fisheries production for the benefit of the industry and to preserve endangered marine species—have affected its culture (behavioral norms and operational codes). Then, the article explains agency changes in terms of crises, competition among affected interests, and development of new scientific knowledge.The article concludes by drawing lessons from the SSL controversy in the North Pacific which may pertain to national and global biodiversity conflicts. These concern the role of law in biodiversity protection, the role of science, and agency capacity for change.  相似文献

An important component of science-based fisheries policy is the provision of habitat adequate for population renewal. In Canada, the Fisheries Act pays little attention to managing fish habitat, and was further weakened by changes enacted in 2012. Specifically, determining the role of fish habitat in contributing to fisheries and fish stock recovery is challenging when many stocks have severely declined and no longer occupy former habitats. This study compared the abundance of juvenile fish in coastal vegetated habitats before and after collapse or decline of groundfish stocks in Atlantic Canada. This comparison was done by compiling past studies that surveyed juvenile Atlantic cod (Gadus morhua) and pollock (Pollachius virens) in vegetated habitats across three provinces. Two studies were repeated, and one that already had post-collapse data was analyzed to quantify long-term changes in juvenile abundance. In all three cases substantial reduction in juvenile abundance coincided with declines in adult stocks. However, juvenile fish still occur in coastal habitats and could aid in adult stock recovery. The current version of the Canadian Fisheries Act requires presence of an ongoing fishery to trigger habitat protection. This is problematic as low fish abundance may lead to lowered habitat protection and potentially habitat degradation, with less or lesser-quality habitat for fish in the future. Thus, recommendations are made to repeal the 2012 Fisheries Act changes and enhance current fish habitat legislation. Using a precautionary approach for coastal fish habitat management, particularly in valuing its potential for fish stock recovery, would strengthen Canadian fisheries management.  相似文献

In the first article below, A.M. Olsen, former Director of Fisheries, criticizes the Chattertons' conclusions, maintaining that fisheries should be managed by professionals not politicians and that many of Brian Chatterton's problems during his tenure as Minister of Fisheries were of his own making. In the Chattertons' response, they point out that by allocating management of the resource between various vested interests (including government bureaucracy) a minister is making a political decision. In the third article, R.D. Walkerden, a former Permanent Secretary to Fisheries Ministers in South Australia, offers an administrator's view of the controversy. Detailed and parochial as some of the points at issue appear, the debate provides an illuminating view of some of the ideological and organizational conflicts that can hinder the effective management of a coastal resource.  相似文献

Promoting and attaining sustainable use of resources through community participation is a central tenet of the European Union's (EU) 2013 Reform of the Common Fisheries Policy. A systematic review approach was used to identify participatory fisheries management arrangements within the EU. Following this, the participatory arrangements were categorized based on the nature of the decision-making arrangement, influence and empowerment of the fishing industry. The study identified 40 management arrangements distributed through 8 member states, with a variety of fisheries and institutional settings for participation in fisheries management in the EU. The majority of the partnerships identified are “Functional participation”, i.e., the participatory arrangement is based in pre-determined goals encouraged by higher decision-making levels in order to increase efficiency of management decisions. Interactive partnership was the highest level of participation identified in the systematic review, and is usually more conducive with local arrangements in coastal and small-scale fisheries targeting low mobility species.  相似文献

Fisheries management is increasingly involving a wide range of stakeholders in the decision making process. However, in most fisheries, the set of management objectives are poorly defined, and the implicit importance placed on these objectives may vary considerably both between and within different stakeholder groups. This may lead to conflicts within management advisory groups where members from different stakeholder groups view potential management outcomes substantially differently, and inconsistencies in decision making when changes in stakeholder representation take place. In this paper, the institutional structure of fisheries management in Australia and the roles the different organisations play in shaping fisheries management plans are detailed. An explicit hierarchy of management objectives is developed in collaboration with key managers and policy makers. A large survey of stakeholders involved in Australian Commonwealth fisheries management was undertaken to determine stakeholder preferences relating to these objectives. The results highlight the differences in perspectives regarding the relative importance of the multiple objectives of fisheries management. While on average stakeholder preferences generally correspond with their expected preference set, the results also indicate that there is generally low coherence within stakeholder groups.  相似文献

This paper examines the sustainability of United States fisheries managed under the Magnuson-Stevens Fishery Conservation and Management Act, the law that provides the framework for federal fisheries management. Sustainability across a broad suite of criteria, including health of the fished stock, bycatch, and effects on the habitat and ecosystem, was measured against the Monterey Bay Aquarium׳s Seafood Watch criteria for ecological sustainability. Seafood Watch ratings and numerical scores for U.S. federally managed fisheries were analyzed to elucidate strengths and weaknesses among federally-managed fisheries. Of U.S. federally managed fisheries assessed by Seafood Watch, only 2% are rated “Avoid”, and strong ratings for stock health for nearly all fisheries indicate that the Magnuson-Stevens Act is fundamentally succeeding at maintaining or rebuilding the abundance of targeted stocks. The majority (79%) of U.S. fisheries earn the intermediate rating of “Good Alternative”, and 19% earn the top rating of “Best Choice”. Given that U.S. fisheries management is considered among the strongest in the world, this analysis assesses why the majority of U.S. fisheries are not rated “Best Choice”. Fisheries for all variety of species, and using a wide range of fishing methods, can merit “Best Choice” status. However, the majority of U.S. fisheries do not achieve this rating due primarily to bycatch concerns. By improving performance with regard to bycatch, most “Good Alternative” U.S. federal fisheries could reach “Best Choice” status and reap rewards in the marketplace for that recognition. Findings suggest that current science-based management should be maintained in the Magnuson-Stevens Act reauthorization, managers should adopt best practices based on fisheries that are already performing well in the U.S., and more specific federal bycatch mitigation requirements should be implemented.  相似文献

The Canadian Beaufort Sea is one of the last places on Earth that has not experienced large-scale commercial fisheries. The aboriginal people of the western Canadian Arctic, the Inuvialuit, have become increasingly concerned about the potential effects of large-scale commercial operations on key subsistence species of fish and marine mammals and the marine ecosystem upon which they depend. A 1984 comprehensive land settlement agreement (treaty) between Canada and the Inuvialuit established a co-management regime for limited aspects of fish and marine mammal resource management, and gave the Inuvialuit rights to subsistence fisheries and existing commercial fisheries but no preference for new commercial fisheries. The Fisheries Joint Management Committee (the fisheries co-management body), the Canada Department of Fisheries and Oceans, the Inuvialuit Regional Corporation and the Inuvialuit Game Council have developed an integrated fisheries management framework agreement for the review and assessment of any proposed commercial fisheries within the Canadian Beaufort Sea. The agreement provides clarity and transparency for decision making and strengthens the protection of fish stocks. The development of the framework depended upon a history of cooperation between the parties and a bridging initiative by the Fisheries Joint Management Committee and an NGO that brought together the Inuvialuit and the government.  相似文献

Emerging as an innovation for improving the management of overexploited fisheries around the world, rights-based fisheries management systems are being implemented in the form of either species- or area-based management. While there are numerous reviews on species-based management, there have been none on area-based management. To fill this gap, we undertake a critical review of the literature on area-based management systems known as “Territorial Use Rights for Fisheries” (or TURFs). Following an exhaustive search, seventy-nine peer-reviewed journal papers discussing the evolution, effectiveness, enforcement, and management context of TURFs were identified and selected. Review of these papers reveals that there is a growing interest in investigating the real-world effects of TURFs, both positive and negative. The variability in TURF performance appears to be due to design features, enforcement behavior of fishers, and specific contextual conditions, namely, biological fishery characteristics, socio-economic aspects of fishers, and institutional arrangements. The bulk of the published research has focused on theoretical analysis and empirical evidence based on fishers’ perception and experience. And there has been little research on enforcement issues or how design features and management contexts influence performance. This review emphasizes the need for rigorous empirical analyses of TURF effects, including assessment of the cost-effectiveness of different enforcement schemes and the effects of contextual conditions on TURF performance. Addressing current shortcomings in the literature could improve the design, implementation and performance of TURFs worldwide.  相似文献

Safety at sea is a serious issue for the commercial fishing industry; it ranks highly in all assessments of occupational dangers including risk-taking, injuries, and fatalities. This paper examines the impact of fisheries management on safety at sea and the use of fishermen's input in the safety regulatory and management process. Using case study techniques of analysis, 22 boatowners, captains and crew all with a minimum of 10 years experience in the commercial fishing industry and from a common New England port (New Bedford) are interviewed. Findings strongly suggest that regulations that have been primarily designed to reduce pressure on fish stocks may also result in increased pressure on fishermen and decreased safety at sea. Attitudes about the role of the New England Fisheries Management Council and improvements to the safety regulatory and management process particularly with regard to the increased participation by fishermen are also examined.  相似文献

Oregon's Developmental Fisheries Program is designed to encourage the commercial exploration and development of State managed underutilized fishery resources. A key program strategy is allocating relatively secure harvest rights to pioneering entrepreneurs when a fishery successfully transitions from “developing” to “developed” status. Since the program's inception in 1993, two fisheries, sardine and bay clam, have moved from undeveloped to developed status. Case studies of these fisheries show that many challenges impact the success of the Developmental Fisheries Program including difficulties in designing and allocating asset rights, establishing operational program guidelines, selecting measurable targets that meet legislative standards for a developed fishery, and financing developmental fisheries management practices. Developmental fisheries strategies used in other regions and countries are summarized. Recommendations are made for improving Oregon's Developmental Fishery Program including establishing clear objectives and timelines for the Program and identifying appropriate renewal requirements for permits and other developmental incentives on a fishery-by-fishery basis.  相似文献

Conservation and management of transboundary fisheries must account for diverse national interests while adopting compromises necessary to develop and implement robust conservation and management measures. The United Nations Fish Stocks Agreement requires states to ensure that conservation and management measures for straddling and highly migratory fisheries do not transfer a disproportionate burden of conservation action onto developing states. However, fulfilling this obligation in transboundary fisheries is undermined by the lack of agreed transparent frameworks for assessing the impact of alternative conservation and management measures, and distributive decision making processes for adopting measures that meet scientific and equity obligations. A new informal and multi-disciplinary research partnership, the Fisheries Equity Research Network, has been established to encourage international research into the equitable distribution of conservation limits in trans-boundary oceanic fisheries. The Fisheries Equity Research Network will research transparent and equitable rules and frameworks for assessing and distributing conservation burdens in transboundary fisheries.  相似文献

Fisheries management receives valuable, but often fragmented information from academic disciplines such as biology, economics, and social sciences. A multi-disciplinary perspective seems to be necessary if the fisheries are to become sustainable. Globally, overcapacity is considered as the most serious threat to sustainable fisheries, which indicates the need for a stronger integration of technological aspects into fisheries management. This paper discusses application of systems engineering principles and integration of technology into fisheries management. The systems engineering process facilitates implementation of multi-disciplinary information from researchers to fisheries managers in the decision-making towards sustainable fisheries, but may also be used to overcome multi-disciplinary obstacles among scientists. The article concludes that use of systems engineering principles may become a valuable contribution to fisheries management because of increased transparency and reduced risk associated with the decision-making process.  相似文献

Scientific information on the shrimp and groundfish resources of the Brazil–Guianas continental shelf has been produced by the United Nations Food and Agriculture Organization (FAO) and the Caribbean Regional Fisheries Mechanism (CRFM), in collaboration with the national governments exploiting the resources, since the early 1970s. In spite of the availability of such information, largely as grey literature, there is limited evidence as to the extent it is being used in fisheries management in Trinidad and Tobago. The flow of information between multiple stakeholders − fishing industry, scientists, fisheries managers, policy makers, and fisheries advisory bodies − was studied based on responses to a survey of key individuals to document each of their roles in the creation, distribution, and use of fisheries information. Content analysis of responses was completed to determine the opportunities and barriers for using scientific information in fisheries management. Salience, credibility, and legitimacy of the information were shadowed by barriers that decreased these attributes. Knowledge about the fishery has increased and technical capabilities have been strengthened through research. At the same time, advances in digital technology have made information more accessible. Yet, the high technical content of fisheries information reduced its usefulness to some stakeholders and formal systems do not exist for distributing or measuring the use and influence of such information in decision making. Communication strategies to promote awareness of the scientific information and aligning scientific information with fisheries policy could increase its use and influence. Institutional support for partnerships and education to encourage stakeholder involvement could also facilitate increased influence of scientific information.  相似文献

The industrial fisheries of Fiji have had mixed fortunes. The fresh fish export industry has grown rapidly in importance so that fisheries is now the third most valuable export industry; its positive effect on the economy is mainly in the increase in the purchase of goods and services, such as air freight. The present ‘hands off’ policy by government in the fresh fish export industry should continue until the industry matures. In the longer run, ad valorem royalties should be considered as a mean of capturing resource rents. The government-owned export cannery has been in financial decline, and the maintenance of the social benefits of regional employment generated by the cannery has come at a high cost to government coffers. The future of the cannery, now leased to a private operator, is clouded by the uncertainty of the continuity of concessional access to European markets beyond the year 2000. The main task faced by government is the management of fisheries and fish stocks. The management of the inshore fisheries — vital to the needs of a large proportion of the population — needs additional resources. The capability for management of the industrial fisheries, necessary to maximise long term public benefits, would be enhanced by full cost recovery through a user pays policy.
