Following the enactment of the Constitution in 1996, the South African government undertook a process of legal reform in the fishing sector. This led to the publication of a new fisheries policy endorsing equity and sustainability, as reflected in the Marine Living Resources Act. This paper examines efforts to implement the policy, particularly the objective of “transformation”, against the background of law reform in fisheries over the last decade. The discussion is located within the context of related domestic legal developments and current trends in international fisheries law. Methods for enhancing effective implementation of the new fisheries policy are highlighted.  相似文献

On 22 April 2009 the European Commission published its ‘Green Paper on the Reform of the Common Fisheries Policy’. The Green Paper points out a contradiction in policy, noting on one hand that public financial support to the Community's fisheries sector is substantial, but on the other hand such support is often incompatible with other Common Fisheries Policy (CFP) objectives, particularly the need to reduce overcapacities. Providing an analytical framework to better understand the effects of subsidies as well as an overview of existing funding schemes under the CFP, this article aims at answering some of the questions posed by the European Commission within its Green Paper. Answers are based on two ideas: the exploitation of marine capture resources ultimately depends on the level of available fish stocks and that a large share of subsidies fuels the race to fish by inducing investment incentives for the fisheries sector. Policies that have ignored this tend to encourage inefficient and unsustainable fishing as well as the misallocation of public funds. Although support schemes under the CFP have changed in recent years, some problematic support schemes persist. A future reform will have to continue the course taken towards sustainable and efficient approaches to supporting the fisheries industry.  相似文献

This paper highlights the tension between advocacy for ‘Blue growth’ in maritime policy and efforts to safeguard future economic growth via the Marine Strategy Framework Directive. In 2015, policy-makers withdrew three of four proposed Marine Conservation Zones (MCZs) in the Irish Sea from consideration for designation, due to concerns that they could significantly impact on the fisheries sector in Northern Ireland because they overlap with prawn fishing grounds in the Irish Sea. Although research has quantified the potential impact upon fishing vessels, none has quantified the impact upon the fisheries sector nor assessed the significance of this impact. Arguably, MCZ designations (or lack thereof) based on the ‘significance’ of an impact require robust underpinning evidence. This paper reports the findings of an Economic Impact Assessment, which has quantified the impact of a decline in landings upon the Northern Ireland fisheries sector and regional economy (data which is currently absent from the evidence base for the MCZ designation process in England). It finds that this will incur job losses in three fishing ports in Northern Ireland, but is unlikely to have a significant impact upon Northern Ireland's fisheries sector and regional economy in terms of jobs and Gross Value Added (GVA). In the worst case, the resulting economic impact is a decrease of £1.05–1.12 m/year GVA in Northern Ireland, which is 1.1% of the contribution of fishing and fish processing to the regional economy. Economic significance assessments, using this methodology, may be useful in supporting the evidence base underpinning MCZ designation and other aspects of marine planning.  相似文献

Sustainable fisheries are the main objective of Norwegian fisheries management. Despite powerful management tools, sustainability in the fisheries sector is not an easy task. There is no formal definition of the concept, and operationalization is vague. In recent years, private actors and non-governmental organizations (NGOs) have increased their impact on defining sustainability in the fisheries, which has reduced the power of the traditional fisheries management to determine its content. The lack of a clear strategy for fisheries management to increase sustainability makes it timely to address three research questions: (i) what is meant by “sustainable fisheries”, (ii) to what extent has the institutionalization of the Norwegian fisheries management channeled the sustainability concept towards specific trajectories, and (iii) what are the options and hard choices available to increase sustainability in the Norwegian fisheries in the future? The cod resources in the Barents Sea constitute the most important fisheries in Norway. In order to reduce resource allocation conflicts among different gear and vessel groups and to ensure profit for all participants throughout the value chain, the sector is thoroughly organized. The institutions established to ensure long-term sustainability, have been developed within the framework of a joint Norwegian–Russian fisheries management regime. However, due to a very high fishing mortality, the cod stock is now under severe pressure. In addition, a major part of the cod fisheries is highly seasonal and unable to be a stable supplier to neither the land-based industry nor demanding international markets. In parallel, cod farming is expected to become a new emerging industry, with potential to copy the success of farmed Atlantic salmon. Many actors within the cod fisheries fear the future competition from the growing cod farming sector. With reference to important attributes that characterize the cod fisheries and cod farming, this paper discusses how a future farming industry may affect the traditional cod fisheries. Moreover, we discuss how the fisheries may be forced to organize in the future to encounter the expected competition from cod farming.  相似文献

This article uses New Zealand as a case study of processes relating to the inclusion of recreational fisheries in modern fisheries management systems based on Individual Transferable Quotas (ITQs). The New Zealand case highlights challenges governments often meet when attempting to integrate the recreational sector into fisheries management, including: (a) resistance to restrictions on what has historically been free-of-charge public access to fish for recreational purposes and (b) the fragmented character of the recreational sector, which makes it difficult to have recreational interests attend to their management role and responsibilities.  相似文献

Most fisheries management studies have concentrated on understanding resource dynamics and have paid less attention to understanding the dynamics of those who use the resources. This situation limits the knowledge about the fisheries system as a whole and specifically about the viability of management schemes. It is vital to understand how the actors within the fishing sector (fishing firm owners/managers, fishers, fisheries managers, and traders) may respond to changes in fishing resources trends, market dynamics, and fisheries policies before they are implemented. These issues are explored in this paper by applying a longitudinal analysis of the Yucatan Mexico's fishing industry. The analysis is presented within the framework of the theory of change and coping strategies. The study primarily involved interviews during 2008 with the main owners of companies in the fishing industry and with fisheries managers and other stakeholders. Time-series catch data on the main fishing resources are also reviewed to evaluate changes across three historical periods and describe how the actors have perceived and responded to those changes. Given conditions of uncertainty in resource availability, changes in market demand and changes in institutional arrangements, the viability of traditional business and resource management practices are discussed. The analysis presents different kind of triggers that have modified the conditions of the fishing sector and had had impacts on the socio-economic–ecological system in which fisheries are embedded. The need for adaptive strategies in the whole chain of the fisheries business and resource management is stressed, given the current changes and conditions of fisheries. The discussion states a series of actions that could improve the relationships between business practices and fisheries management.  相似文献

Currently there is a strong interest in Cuba in improving the performance of the fisheries sector with respect to social, biological, and economic outcomes. Many important fishery resources appear to be overexploited, and previous fishery regulations have had mixed success in restoring fishery stocks. The current fishing pressure could also have adverse impacts on other valuable ecosystem services that support economic activities such as dive tourism and recreational fishing. A new State policy to expand cooperative enterprises to non-agricultural sectors provides an opportunity for fishery cooperatives to be created for the first time since the early years of the Cuban Revolution. This paper explores the potential ecological, social, and economic benefits of adopting fishery cooperatives as a co-management scheme for Cuba's marine fisheries. It concludes that well-designed fishery cooperatives can offer substantial benefits to the management of the fishery sector. Based on an analysis of the relative success of fishing cooperatives worldwide, guidelines are provided for the design of fishery cooperatives in Cuba.  相似文献

This paper undertakes a critical assessment of the present state of fisheries insurance in India. Various factors that contribute to the poor performance of fisheries insurance in the country were identified and ranked based on the responses of fishermen and fish farmers in major maritime states. In the light of the findings, measures such as leveraging the potential of technological interventions, developing innovative institutional mechanisms, bridging the trust deficit amongst the stakeholders and bringing about attitudinal changes through awareness drives are suggested as way forward towards harnessing the potential of insurance as a safety net tool in fisheries sector of India.  相似文献

Fisheries management receives valuable, but often fragmented information from academic disciplines such as biology, economics, and social sciences. A multi-disciplinary perspective seems to be necessary if the fisheries are to become sustainable. Globally, overcapacity is considered as the most serious threat to sustainable fisheries, which indicates the need for a stronger integration of technological aspects into fisheries management. This paper discusses application of systems engineering principles and integration of technology into fisheries management. The systems engineering process facilitates implementation of multi-disciplinary information from researchers to fisheries managers in the decision-making towards sustainable fisheries, but may also be used to overcome multi-disciplinary obstacles among scientists. The article concludes that use of systems engineering principles may become a valuable contribution to fisheries management because of increased transparency and reduced risk associated with the decision-making process.  相似文献

The harbour porpoise (Phocoena phocoena) is the focus of a range of conservation efforts and policies, including the Habitats Directive, aimed at reducing the bycatch of non-target species in gillnet fisheries. This paper describes the governance process and analyses the governance mechanisms and conflicts surrounding ongoing fisheries management planning with a focus on two Natura 2000 sites in the Danish part of the Skagerrak Sea designated to protect harbour porpoises. Responsibility for developing fisheries management for Natura 2000 sites is solely the remit of the fisheries agency, including mechanisms related to stakeholder involvement. This approach fuels the efficiency of the decision making process, while full transparency and/or co-decision becomes less of a given within a ministry for an economic sector compared with the environment ministry. In relation to porpoises, conflicts are driven mainly by the economy and the varying perceptions of the bycatch issue, with great differences between government, NGO's and fishers. Interviews with fishers and fishing effort data reveal intra-sectoral conflicts pertaining to the incompatibility of active trawling and passive gillnetting in the areas. The paper questions the overall approach to managing the harbour porpoise bycatch issue in light of Natura 2000 and discusses the role of science and its high level of influence in this planning process.  相似文献

Factory trawlers are the most controversial vessel group in Norwegian fisheries. At the time the fleet emerged, stern trawling in combination with on-board processing of cod fillets was regarded as a major innovation. However, the deep-sea fleet was intended to be a stable supplier of fish to the land-based industry. Factory trawlers were not a part of the political project. On the contrary, the vessels represented a serious departure from the traditional employment system for the fisheries’ dependent districts. Factory trawlers have, since the seventies, been regarded as the main enemy to the coastal vessels and the land-based industry. The vessels have been subject to a profound debate about several built-in contradictory goals for the fisheries policy, such as the ideal of employment for all and the need for a profitable sector without state subsidies. Despite a series of policy-driven initiatives to remove the factory trawlers, the fleet has been one of the most profitable vessel groups in the Norwegian fisheries. Nonetheless, the fleet is now marginalised in the number of vessels and transformed into an obedient supplier of round fish to the land-based industry. In this article, we outline the history of the Norwegian factory trawlers and how the fleet was subject to a series of critical changes reflecting the complexity of the vessels.  相似文献

Information on the cost of fishing is integral in measuring fisheries performance and correctly evaluating the economic impacts of fisheries regulations and management rules. However, limited availability of cost data often renders such analyses either incomplete or implausible. This study discusses a survey effort that was undertaken in the Northeast US to collect fisheries annual fixed cost data directly from commercial fishermen. Stratified random samples of fishing vessel owners were surveyed in 2012 and 2013. An overview of the survey procedures, sample selection and administration is given here. The data cleaning process, non-response bias and data summaries are also presented. A modeling framework is discussed for estimating fisheries cost data. Robust cost models in combination with regular data collection efforts will allow for more complete economic and financial analyses relevant to fisheries management and conservation.  相似文献

The Pacific Islands region includes some of the smallest countries in the world, some of which are in a precarious economic condition and heavily reliant on the region's tuna fisheries for revenue and food security. The ability of some of these countries to profit from their fisheries resources, and effectively conserve these resources for future generations, is undermined by a combination of economic, governance and institutional weaknesses that make these countries vulnerable to corruption in the fisheries sector.  相似文献

Harvest cooperatives were implemented in several US fisheries over the last decade during a period when US law prohibited implementation of any new individual fishery quota (IFQ) systems. Harvest cooperatives provided an alternative to individual quotas as a means to end the race for fish and increase fishery profitability. The prohibition on new IFQ systems in the US was lifted, but harvest cooperatives remain a more feasible and perhaps a superior alternative to IFQs for some fisheries. The New England Fishery Management Council is on the verge of implementing a new management system for the groundfish fishery based on harvest cooperatives known as “sectors”. This paper describes the New England sector management system and discusses a number of advantages but also some drawbacks relative to IFQs. It argues that a hybrid of the two approaches could have advantages over either.  相似文献

This is the first regional study of artisanal fisheries in Pacific Island countries and territories that demonstrated that the future of the region's artisanal fishery sector and the livelihood of coastal communities will be highly dependent on alternative subsistence and income sources, which are necessary to reduce fishing pressure to a sustainable level to maintain ecosystem services and food security. The overall objective of this study was to identify socio-economic indicators and drivers to improve the understanding of the dynamics between socio-economic conditions and current exploitation levels of finfish and invertebrates of coastal communities in 17 Pacific Island countries and territories. We showed that exploitation rates and thus possible overexploitation are not solely the consequence of a simple demographic growth process but are in fact a result of the choices people have. Our results confirmed a close relationship between resource exploitation rates and economic development at the national level and the availability of alternative income opportunities at the community level. Multivariate analysis results suggest that communities in countries with somewhat unfavourable conditions and limited access to alternatives and fishing households in communities with overall favourable economic conditions are at highest vulnerability as they have the highest dependence on coastal fisheries resources. Alternative economic opportunities at the national scale and availability of alternative income at the community level vary significantly between cultural groups. Based on our results, the development of management strategies with realistic expectations of ensuring livelihood of coastal communities and sustainable resource use in Pacific Island countries and territories requires a hierarchical and integral approach. Major drivers identified at the regional, cultural and local levels should be used to identify priorities, to assess overall advantages and limitations at the different levels as well as the vulnerability of communities targeted, and to develop strategies accordingly.  相似文献

Fisheries co-management in the Shiretoko World Natural Heritage area was expanded to ecosystem-based management, in which the fisheries sector plays an essential role in management. A marine management plan was drawn up to define the management objectives, strategies to maintain major species, and methods for ecosystem monitoring. A network of coordinating organizations from a wide range of sectors was established to integrate policy measures. Experience from this case could inform ecosystem-based management in other countries where large numbers of small-scale fishers take a wide range of species under a fisheries co-management regime.  相似文献

Andalusia is a region of Spain with an area of some 90,000 km2 and almost 900 km length of coastline. It has an important tradition in the fishing industry that makes it one of the areas of the European Union where fisheries policies have a great significance for the population. The present statistical study deals comprehensively with the so-called “artisanal fleet”, especially in respect of data on the typology of vessels (construction particulars) and on the extractive effort made (distances and depths where they fish, duration of fishing voyages, the fishing gear used and target species), with the aim of presenting a new approach in the policies for regulating this important fisheries sector.  相似文献

This article presents the first bottom-up analysis of the proportion of global marine fisheries subsidies to small-scale fisheries (SSF). Using existing data, the reported national subsidy amounts are split into the fraction that goes to small- and large-scale fishing sectors. Results reveal a major imbalance in subsidy distribution, with SSF receiving only about 16% of the total global fisheries subsidy amount of $35 billion in 2009. To bring this into perspective, a person engaged in large-scale fishing received around 4 times the amount of subsidies received by their SSF counterparts. Furthermore, almost 90% of capacity-enhancing subsidies, which are known to exacerbate overfishing go to large-scale fisheries, thus increasing the unfair competitive advantage that large-scale fisheries already have. The developmental, economic and social consequences of this inequity are huge and impair the economic viability of the already vulnerable small-scale fishing sector. Conclusions indicate that taxpayers' money should be used to support sustainable fishing practices and in turn ocean conservation, and not to foster the degradation of marine ecosystems, often a result of capacity-enhancing subsidies. Reducing capacity-enhancing subsidies will have minimal negative effects on SSF communities since they receive very little of these subsidies to begin with. Instead, it will help correct the existing inequality, enhance SSF economic viability, and promote global fisheries sustainability.  相似文献

This paper presents an analysis of the effectiveness of the community structural policy in the fisheries sector by comparing the relative level of compliance with objectives (reduction of fleets and economic viability) with the mechanisms that have been implemented (structural funds and allocation of quotas). On the one hand, this analysis shows that there is a positive correlation between the level of structural funds and the attainment of goals. On the other hand, it was found that the greater the relative availability of quotas, the poorer the countries performed in complying with the objective of reducing the fishing capacity, and the higher the expectations of achieving acceptable yields.
