The Canadian Beaufort Sea is one of the last places on Earth that has not experienced large-scale commercial fisheries. The aboriginal people of the western Canadian Arctic, the Inuvialuit, have become increasingly concerned about the potential effects of large-scale commercial operations on key subsistence species of fish and marine mammals and the marine ecosystem upon which they depend. A 1984 comprehensive land settlement agreement (treaty) between Canada and the Inuvialuit established a co-management regime for limited aspects of fish and marine mammal resource management, and gave the Inuvialuit rights to subsistence fisheries and existing commercial fisheries but no preference for new commercial fisheries. The Fisheries Joint Management Committee (the fisheries co-management body), the Canada Department of Fisheries and Oceans, the Inuvialuit Regional Corporation and the Inuvialuit Game Council have developed an integrated fisheries management framework agreement for the review and assessment of any proposed commercial fisheries within the Canadian Beaufort Sea. The agreement provides clarity and transparency for decision making and strengthens the protection of fish stocks. The development of the framework depended upon a history of cooperation between the parties and a bridging initiative by the Fisheries Joint Management Committee and an NGO that brought together the Inuvialuit and the government.  相似文献

This paper reviews some of the major issues in the international transfer of technology and the role of international organizations such as the United Nations in the transfer of technology. In 1975, the UN General Assembly endorsed the New International Economic Order (NIEO) which contained many resolutions including improvement of the terms of technology transfer in favor of developing nations. The mandatory provisions of the 1982 United Nations Convention on the Law of the Sea (1982 Convention) became a turning point in the evolution of the role of the international organizations to control the transfer of technology. Although the significance of technology in economic development of the developing countries has been recognized, provisions of the 1982 Convention on technology transfer came under serious scrutiny in the 1980s. In 1994, the discontent with the 1982 Convention among the industrialized countries and the growing popularity of market ideology among the developing countries led to an amendment to the Convention which adopts a market approach for the dissemination of technology and stresses the importance of environmentally sound technology.  相似文献

On 4 August 1995, the UN Conference on Straddling Fish Stocks and Highly Migratory Fish Stocks adopted an Agreement for the conservation and management of straddling and highly migratory fish stocks. The mandate given by the General Assembly required that the results of the Conference be fully consistent with the UN Law of the Sea Convention. The purpose of this article is to examine the significance of the agreement for the law of the sea as embodied in the Convention. It shows that the agreement constitutes an important contribution to the Convention in that it facilitates the implementation of the Convention's provisions, strengthens the Convention's regime, and further develops general or framework rules of the Convention. The most significant contribution lies in the development of the law with respect to such issues as the precautionary approach to fisheries, compatibility of conservation and management measures adopted for areas under national jurisdiction and those for the adjacent high seas areas, the role of regional organizations or arrangements, duties of the flag State, enforcement against foreign vessels on the high seas, and port State jurisdiction.  相似文献

Leatherback turtles migrate across the jurisdictions of multiple sovereign states and present complex challenges to those responsible for their conservation. Concern for marine turtles has led to their protection under range state legislation and protective listing under a suite of multilateral environmental agreements. Evidence suggests that a distinct, reproductive sub-population of leatherback turtles is shared amongst a number of northern Caribbean range states, including the UK overseas territories (UKOTs) of Anguilla and the British Virgin Islands (BVI). The post-nesting movements of three female leatherbacks were tracked after they nested in Anguilla (n=1, tracked for 228 days) and the BVI (n=2, tracked for 12 and 13 days, respectively). These turtles used territories of multiple range states, with the leatherback tracked from Anguilla also migrating through high seas to foraging grounds in Canadian waters. In addition, a review of regional leatherback flipper tag return records helps define the range of this northern Caribbean nesting population (NCNP), which appears to be in recovery in some range states. While national legislation and conservation efforts appear to have contributed to these population recoveries, most relevant MEAs appear to have played little or no role. However, opportunities for constructive dialogue between NCNP range states exist under the Cartagena Convention the United Nations Convention on the Law of the Sea and the International Commission for the Conservation of Atlantic Tuna (ICCAT). UKOT conservation managers would, therefore, be justified in prioritising unilateral leatherback conservation action, and multilateral efforts through the Cartagena convention and regional fishery management mechanisms, over potentially costly accessions to additional MEAs.  相似文献

The fisheries systems which have developed in the European Economic Community (EEC) and Eastern Canada show striking similarities and contrasts. Both show efforts directed at conserving the resource base while setting limits for annual catches and allocating shares in these catches among fishermen. Canada has had less pressure on its resources and has been more successful in restraining over-fishing tendencies; it also has a more fully co-ordinated and effective management system. On the other hand the EEC has greater efficiency in catching, marketing and processing, and in recent times has had less government aid. Better systems would combine Canadian management efficiency with EEC economic efficiency.  相似文献

Internationally, shark conservation is now being recognized as a major environmental challenge, but management efforts to halt the overexploitation of sharks have lagged behind. This review examines the state of knowledge for shark species in Canadian waters and analyzes the role of existing management and legislation in ensuring shark conservation. Despite Canada's early leadership, the present management framework reveals major shortcomings with regard to legal protection, bycatch and finning regulations. These problems are not unique to Canada but illustrate broader issues pertaining to the global management of endangered fish species. To strengthen the conservation and management of sharks, this paper recommends a set of key policies and management priorities, which exemplify proper precautionary management of endangered shark species in Canada and could serve as a blueprint for improving conservation efforts internationally. A structured approach for grading progress in shark conservation efforts against best practices is also presented and could be used as a goalpost elsewhere.  相似文献

The cruise tourism industry in the Canadian Arctic has the potential be an important contributor to the northern economy, but undue complexity in the permitting and regulatory process represents a major barrier to cruise operators and as a result seems to be limiting development potential and other cultural and educational benefits related to tourism in the region. Based on a set of interviews and follow-up interviews with Arctic cruise operators and government permit issuers (n=48), investigative phone calls (n=22), and follow-up verification calls (n=20+), analysis of the management system that currently governs cruise tourism in Arctic Canada is provided including recommendations for improvement. There are currently over 30 permits, approvals, and notification processes for cruise companies operating in the Canadian Arctic (collective called ‘permits and permissions'). Permits and permissions are required for vessel safety, environmental protection, gaining access to national parks, and visiting heritage and archaeological sites among others. They are issued by numerous agencies under multiple jurisdictions and statutes with no integration or organizing system. The result is a process that is overly complex, repetitious, and costly for operators. In comparison, the permitting systems in Greenland and Svalbard are more streamlined, causing some cruise companies to consider abandoning Canadian waters in favour of these less bureaucratic regions. Federal and territorial attention is required to create efficiencies in the cruise permitting process in Arctic Canada if the economic, socio-cultural, and educational benefits of the industry are to be fully realized.  相似文献

An important component of science-based fisheries policy is the provision of habitat adequate for population renewal. In Canada, the Fisheries Act pays little attention to managing fish habitat, and was further weakened by changes enacted in 2012. Specifically, determining the role of fish habitat in contributing to fisheries and fish stock recovery is challenging when many stocks have severely declined and no longer occupy former habitats. This study compared the abundance of juvenile fish in coastal vegetated habitats before and after collapse or decline of groundfish stocks in Atlantic Canada. This comparison was done by compiling past studies that surveyed juvenile Atlantic cod (Gadus morhua) and pollock (Pollachius virens) in vegetated habitats across three provinces. Two studies were repeated, and one that already had post-collapse data was analyzed to quantify long-term changes in juvenile abundance. In all three cases substantial reduction in juvenile abundance coincided with declines in adult stocks. However, juvenile fish still occur in coastal habitats and could aid in adult stock recovery. The current version of the Canadian Fisheries Act requires presence of an ongoing fishery to trigger habitat protection. This is problematic as low fish abundance may lead to lowered habitat protection and potentially habitat degradation, with less or lesser-quality habitat for fish in the future. Thus, recommendations are made to repeal the 2012 Fisheries Act changes and enhance current fish habitat legislation. Using a precautionary approach for coastal fish habitat management, particularly in valuing its potential for fish stock recovery, would strengthen Canadian fisheries management.  相似文献

There remain overlapping claims of jurisdiction by Canada and the US related to the 1984 Gulf of Maine boundary decision. The disputed territory, known as the grey zone, is a rich lobster fishing area and a simmering dispute between Canadian and US lobster fishers finally erupted here in August 2002. Non-indigenous species (NIS) can create significant risks when introduced to foreign ecosystems. One of the many vectors facilitating the global transport of NIS is ballast water, and as commercial shipping increases so does the threat of ballast water-mediated introductions. Despite Canadian regulations, consistent with international guidelines put forth by the International Maritime Organization in the early 1990s, ballast water remains a potential vector for the introduction of many NIS to Canadian marine ecosystems: there have been no new introductions in the Laurentian Great Lakes Region since 2006, yet marine ecosystems continue to see the introduction and establishment of NIS. This paper details and analyzes the development of Canadian ballast water management (BWM), in the context of marine ecosystems, and identifies issues therein. BWM in Canada has a number of management gaps that have persisted since large-scale BWM began in the late 1980s. These include BWM exemptions for vessels not exiting the North American continental shelf, and limitations of effectiveness of mid-ocean exchange as the predominant management method in marine ecosystems. In addition, ballast water regulations for the Canadian Arctic may require additional consideration as the Arctic will likely continue to see an increase in both warming and commercial shipping in the future, thereby increasing the potential risk of NIS. In order to adequately protect all Canadian marine ecosystems, it is recommended that the current BWM regime: fill gaps in management to help prevent further introduction and spread of NIS; focus equally on both marine and freshwater regions, and; look to other aggressive BWM strategies such as those being developed by the state of California.  相似文献

The author surveys some of the principal amendments to the Barcelona system adopted at the Ninth Ordinary Meeting of Contracting Parties to the Barcelona Convention in June 1995 and underlines the new national responsibilities for the implementation of the policy, legal and institutional changes in the direction of sustainable development. Emphasis is placed on the types of human resources that will be needed to facilitate implementation and render the regime effective at both national and regional levels. The author advocates a role for Mediterranean universities to assist regional regime-building through the development of relevant marine affairs education programmes in support of the Mediterranean Action Plan (MAP). A catalytic role for the United Nations Environment Programme (UNEP)/MAP Coordinating Unit in mobilizing inter-university cooperation is also identified.  相似文献

Illegal practices of marketing licences and holding multiple Lobster licences have been developed through time by fishermen in the Maritimes Provinces of Canada. The consequences of these practices have an impact on fishing activity that interferes with management goals and efficiency and threatens social organisation of fishing community. This article shows their development through the back and forth movement between the building of limited entry policy and fishermen's responses to it since the introduction of limited entry to the Canadian lobster fishery in 1967. Recent changes to American limited entry policies in Massachusetts and the Maine have attempted avoided some of the problems experienced in Canada.  相似文献

By reviewing the history of fishery exploitation in the coastal waters of west Canada and east Korea, related with contrasting life history strategies of the dominant species, the fishery management challenges that each country would face in the upcoming decades were outlined. In the ecosystem of the Canadian western coastal waters, the dominant oceanographic feature is the coastal upwelling domain off the west coast of Vancouver Island, the northernmost extent of the California Current System in the eastern North Pacific. In the marine ecosystem of the eastern coasts of Korea (the Japan/East Sea), a major oceanographic feature is the Tsushima Warm Current, a branch of the Kuroshio Current in the western North Pacific. Fishes in the Canadian ecosystem are dominated by demersal, long-lived species such as flatfish, rockfish, sablefish, and halibut. During summer, migratory pelagic species such as Pacific hake, Pacific salmon, and recently Pacific sardine, move into this area to feed. In the late 1970s, Canada declared jurisdiction for 200 miles from their coastline, and major fisheries species in Canadian waters have been managed with a quota system. The overall fishing intensity off the west coast of Vancouver Island has been relatively moderate compared to Korean waters. Fishes in the ecosystem of the eastern Korean waters are dominated by short-lived pelagic and demersal fish. Historically, Korea has shared marine resources in this area with neighbouring countries, but stock assessments and quotas have only recently (since the late-1990s) been implemented for some major species. In the Korean ecosystem, fisheries can be described as intensive, and many stocks have been rated as overfished. The two ecosystems responded differently to climate impacts such as regime shifts under different exploitation histories. In the future, both countries will face the challenge of global warming and subsequent impacts on ecosystems, necessitating developing adaptive fisheries management plans. The challenges will be contrasting for the two countries: Canada will need to conserve fish populations, while Korea will need to focus on rebuilding depleted fish populations.  相似文献

Since the advent of Global Navigation Satellite Systems, it has been possible to perform hydrographic survey reductions through the ellipsoid, which has the potential to simplify operations and improve bathymetric products. This technique requires a spatially continuous separation surface connecting chart datum (CD) to a geodetic ellipsoid. The Canadian Hydrographic Service (CHS), with support from the Canadian Geodetic Survey, has developed a new suite of such surfaces, termed Hydrographic Vertical Separations Surfaces, or HyVSEPs, for CD and seven tidal levels. They capture the spatial variability of the tidal datum and levels between tide gauges and offshore using semiempirical models coupling observations at tide stations with relative sea-level rise estimates, dynamic ocean model solutions, satellite altimetry, and a geoid model. HyVSEPs are available for all tidal waters of Canada, covering over seven million square kilometers of ocean and more than 200,000 kilometers of shoreline. This document provides an overview of the CHS's modeling approach, tools, methods, and procedures.

The HyVSEP for CD defines the new hydrographic datum for the tidal waters of Canada. HyVSEPs for other tidal levels are fundamental for coastal studies, climate change adaptation and the definition of the Canadian shoreline and offshore boundaries. HyVSEPs for inland waters are not discussed.  相似文献

The Commission for the Conservation of Antarctic Marine Living Resources (CCAMLR) has been working to develop and implement a system of marine protected areas (MPAs) for over 10 years. Within CCAMLR there is a long-held belief that the area covered by the CCAMLR Convention is equivalent to a category IV protected area as defined by the International Union for Conservation of Nature (IUCN). This belief was founded upon a comparison of the central objective of CCAMLR as defined by the CCAMLR Convention with the IUCN definition of a category IV MPA. This advice was accepted by the CCAMLR Scientific Committee but to date there has not been any analysis of this advice within CCAMLR, IUCN or in the literature. This paper critically analyses that advice, and finds that the CCAMLR Convention area does not meet the IUCN definition of an MPA and thus the CCAMLR Convention Area cannot be considered equivalent to a category IV MPA.  相似文献

Fisheries management systems everywhere tend to be dominated by the proprietary claims of nation states. These claims are embodied in a number of international agreements such as the United Nations’ Convention on the Law of the Sea, which accords rights to nation-states on the basis of adjacency and historic use. In this paper, we present results from research in Nova Scotia, Canada, to demonstrate that small boat fishing families in that region have been continuously fishing the grounds adjacent to their communities for many generations, but must now fish those areas on the basis of a state-granted ‘privilege’ rather than a secure right. In this paper we argue that the principles of adjacency and historic use should apply to individuals and fishing families and that states should move towards a more community-determined approach to fisheries management. The lobster fishery of Northeastern Nova Scotia provides a particularly compelling example of how this type of change in management policy could be successfully accomplished.  相似文献

This paper examines key factors used in protecting the migratory North Atlantic right whale within the context of a marine protected area (MPA) system, using the Grand Manan Whale Conservation Area, in New Brunswick Canada, as a case study example. Designated as a conservation area in 1993, before the Oceans Act came into effect, the Grand Manan conservation area currently does not form part of the Canadian network of MPAs. Given the possibility that MPA designation may occur, the paper examines factors that should be considered in meeting International Union for Conservation of Nature (IUCN) MPA design criteria and IUCN evaluation model requirements. An MPA evaluation framework based on an IUCN evaluation model (Hockings et al., 2000 [1]) is designed to assess the effectiveness of an MPA in protecting a migratory right whale. Case study results indicate that current management and research activities for the Grand Manan conservation area address most governance, biophysical and socio-economic issues under an IUCN evaluation framework. On a site basis, it is recommended that the Grand Manan conservation area be designated as a component of the Canadian network of MPAs and that regulations be developed and implemented under the Species at Risk Act to clearly define activities considered damaging or destructive to right whale critical habitat. Recommendations also suggest the preparation of a combined site management-action plan for the Grand Manan conservation area indicating how activities specified in North Atlantic Right Whale Recovery Strategy will be implemented locally. On a regional and international basis, recommendations call for an internationally coordinated and integrated approach to right whale protection within the context of a network of designated critical habitat areas. Recommended activities include: continued Canadian participation in cross-border research and actions to mitigate threats to the right whales over their migratory range; development of a regional right whale management and monitoring strategy; and designation of additional critical habitats in national/international waters. It is further recommended that the evaluation framework developed by this paper be used as a model in assessing the conservation and management effectiveness of MPAs protecting other migratory marine species.  相似文献

The rapid acceptance of the exclusive economic (EEZ) concept belies the broad differences among State claims beyond 12 nautical miles, and the wide gulf between State practice and the United Nations Convention on the Law of the Sea (LOS Convention). This paper first examines the areas of contention between State practice and the LOS Convention. These differences are characterized and the author concludes that the EEZ regime within the Convention does not address the specific individual and regional needs of States that have resulted in the wide discrepancy among State claims. The author suggests a global authority under which the jurisdictional line would be redrawn along the practical level of coastal State to vessel, rather than the political plane of coastal State to flag State.  相似文献
