This study examines the reorganization of formal coordination structures of a unique international public organization involved in marine governance in Europe, namely the structural reorganizations of the International Council for the Exploration of the Sea (ICES) between 1999 and 2009. The findings indicate that the reorganizations of ICES’ formal coordination structures were not driven primarily for reasons of efficiency, by clear and consistent goals, and by clear means-ends considerations for organizational design as proposed by rational perspectives in organization theory. Instead, the formal coordination structures have also been adapted to live up to changing expectations in the institutional environment, to modern management concepts in marine governance such as the Ecosystem Approach to Management (EAM), and to ensure the legitimacy of the organization. However, it is also found that institutional explanations alone are insufficient to comprehensively understand why the formal organizational structures of ICES were reorganized. Instrumental and cultural perspectives in organization theory as well as resource-dependence theory additionally add to understand how ICES responded to external demands and why organizational structures have been changed.  相似文献

Ecosystem approaches to marine resource management (EAM) offer comprehensive decision making based on rationalization of currently fragmented ocean policies and their implementation. However, despite the apparent utility in addressing these problems, EAM has also been criticized as being nonspecific, immature, invalid as a basis for decision making, and not fully supported by science. While it is commonly perceived that a paradigm shift in governance and science institutions awaits implementation to address these criticisms, in fact, ecosystem considerations are being incorporated more frequently, employing existing authorities as the basis for mitigation of sectoral impacts and for resource allocation. Management ‘best practices’ for EAM are emerging based on these experiences. Ten common criticisms of EAM, which I believe to be myths propagated primarily to maintain the status quo among sectoral interests, are discussed. Accelerated evolution of EAM will occur as science better articulates feedbacks, cumulative ecological effects and economic consequences framing policy choices, and more formal “rules of engagement” among sectors (e.g., fishing, coastal development, water quality, and energy) are negotiated. These operating procedures would be established under informal arrangements, in national law, and by international agreement. The management paradigm for marine resources is shifting and EAM will eventually be considered redundant with established practice.  相似文献

This study examined how the United States’ largest marine resource management agency, the National Oceanic and Atmospheric Administration (NOAA), has begun to change its management strategy away from traditional marine resource management approaches towards an Ecosystem Approach to Management (EAM). Surveys were conducted with 57 NOAA scientists and resource managers in nine NOAA programs in 8 different geographic regions across the United States in 2005. A qualitative analysis examined the attitudes and experiences of participants with respect to implementing EAM and identified four major challenges to enhancing cooperation and understanding of EAM. We conclude with recommendations for concrete initiatives that future efforts in EAM that any management agency can undertake to facilitate further ecosystem management opportunities.  相似文献

Marine governance in European seas is at a crossroad aiming towards implementation of eco-system based marine management (EBMM) through integration of different EU policies or directives to protect the environment, while at the same time expected to facilitate growth and employment in support of the blue economy. This article shows that the governance landscape at the regional sea level is very complex, fragmented and faced with several dilemmas. It examines the present governance structures in the four European seas (Baltic, Black, and Mediterranean Seas and North East Atlantic Ocean). It is argued that the implementation of EBMM at the regional sea level is characterized by a highly fragmented European governance system where there is lack of coordination between relevant DGs within the European Commission, between EU, International organisations, Regional Sea Conventions and the Member States and between sectoral governance arrangements that should provide sectoral management measures that support EBMM. The article develops suggestions for a nested governance system in which institutions, policies, laws and sectors are nested into a tiered, internally consistent and mutually re-enforcing planning and decision-making system. Developing institutional interaction and soft modes of governance between the EU, the Regional Sea Conventions, Member States and the governance arrangements of the different marine sectors will be crucial in evolving towards such a nested governance system for EBMM. Moreover, there is no one size fits all approach in implementing EBMM, which means that for each European Sea a context-dependent nested governance system should be developed.  相似文献

The nature of participation by fishing organizations in fisheries management in the Northeast US is changing. Evidence of this is the number of groups that are actively seeking opportunities for group governance of marine resources. This article explores emerging collaborative or co-management arrangements in this region (a process whereby decision-making is shared between federal/council level and fishery stakeholder groups) and the shift towards an ecosystem-based approach to the management of marine fisheries.This research suggests that it is an opportune time for the development of a regional policy in the Northeast that provides an enabling environment in support of decentralized governance of federally managed marine fisheries. It also suggests that these initiatives can play a key role in operationalizing ecosystem-based management.  相似文献

There has been a gradual evolution in fisheries management over the past decades from a focus on sustainability of a single species or stock and resources to a focus on marine ecosystems. Among the issues to be addressed for effective implementation of ecosystem based fisheries management (EBFM) are the appropriate governance arrangements and scale for management. The purpose of this paper is to examine these issues of governance and scale as related to EBFM in tropical developing countries through an analysis of approaches being taken in the Philippines to manage fisheries on a multi-jurisdictional level. The management of fisheries and coastal resources in a number of bays and gulfs, which represent marine ecosystems, is presented. The opportunities and constraints to ecosystem based fisheries management in the Philippines are discussed and lessons for broader application of these governance structures in tropical developing country marine ecosystems are presented.  相似文献

An assessment of management effectiveness of Kenya's oldest marine protected areas (Malindi and Watamu) was conducted within the framework of a regional assessment in Kenya, Seychelles and Tanzania. Biophysical, socio-economic and governance indicators were used to assess the delivery of MPA management objectives. Results indicate that the Malindi and Watamu marine parks that are no-take areas are making progress towards meeting their stated objective of biodiversity conservation. The 1997–1998 ENSO related bleaching event caused the greatest single measurable impact on the coral reefs of the marine parks leading to very high levels of coral mortality. The marine reserve where fishing is regulated was less effective in meeting its objective of sustaining community livelihoods. The weakest trends were related to the development of governance structures. A combination of management inefficiencies due to overlapping mandates, financial and administrative constraints, and inadequate stakeholder participation interacted to reduce the ability of the MPAs to fully achieve their objectives.  相似文献

Marine governance involves interaction between networks and actors from different types and levels of organizations. The concept of multi-level or network governance steps away from the assumptions that supra-national and national government at the macro level is the dominant policy making unit. At all levels information is crucial, among others to overcome social dilemmas of collective action in marine resource use and management. In this paper theories of multi-level governance, of collective action, of trust and of information economics will be linked to the idea of the increasing importance of information, information technologies and information processes in environmental governance, which is termed ‘informational governance’. This linking of theories and concepts results in a new and innovative framework to better understand the changing role of information in marine resource management, enterprises, institutions and actual practices of governance. The framework will help to investigate the effectiveness of informational governance in solving problems related to marine resources.  相似文献

A decade of international discussion on marine biological diversity beyond areas of national jurisdiction (BBNJ) culminated in 2015 with a United Nations General Assembly Resolution to establish an international legally-binding instrument on the conservation and sustainable use of BBNJ. Proponents of the new instrument therefore consider it as an opportunity to eliminate gaps in the current legal regime and promote better coordination. As the next step in the negotiations begins, substantial lessons can be drawn from the 1995 UN Fish Stocks Agreement (UNFSA), which has faced many of the same challenges related to gaps in scientific knowledge, uneven governance and regulatory capacities, and inherent unpredictability, both ecologically and in terms of anthropogenic drivers of change. For BBNJ, however, such challenges are far more complex due to the diversity of stakeholder communities and the diversity of resources involved, including fish and mineral resources with tangible economic values, marine genetic resources of unknown value, and the culturally-specific values attached to charismatic species and conservation in general. Drawing on lessons from UNFSA, it is argued that the establishment of marine protected areas (MPAs) under the BBNJ instrument would be particularly well served by a similar regional approach aligned with existing international agreements. In this regard, it is recommended that the capacity building under the new international instrument on BBNJ should focus inter alia on the secretariats of the regional fishery management organizations in order to enhance intra-regional and inter-regional cooperation and sharing of best practices.  相似文献

Management of the Belize Barrier Reef was originally envisioned through the creation of marine protected areas. However, the influence of land-based activities was not accounted for in Marine Protected Area (MPA) programs. Therefore focus was shifted to an integrated approach via Integrated Coastal Management (ICM). The Belize ICM process has evolved into a system of coordination through the fostering of multi-sectoral linkages for integrated management of coastal resources. Marine protected areas were included in the ICM program as tools for achieving biodiversity protection and management of sensitive habitats. The ICM process has resulted in greater coordination and consultation in decision making for coastal resource issues, the MPA program however has not evolved with the trend of greater community involvement in MPA management. The greatest challenges to MPA and ICM programs in the next 10 years are: improved linkages between the two, fostering of community participation in management, broadening of the scope of ICM to watersheds and ocean governance, and sustainable financing for both programs.  相似文献

New multi-sectoral policies with a regional implementation are developed when maritime states recognise the importance of managing the marine environment under an ecosystem-perspective rather than a use-perspective. In Europe, the Marine Strategy Framework Directive (MSFD) is the first attempt to promote an integrated management of the seas from the coastline to the limit of the Exclusive Economic Zone. This paper shows that, nine years from the MSFD adoption, there remain several ecological, economic, social and governance challenges. Using information gathered in a dedicated survey of the European Union Marine Strategy Coordination Group and in the recent literature the paper identifies the obstacles preventing a successful regional cooperation and policy integration. The survey indicates that the MSFD coordination structures are, in general, well-developed but there is an apparent lack of political will to coordinate actions at the regional level. Member States request greater flexibility to implement the Directive but they put their national interests before the benefit of a coherent and integrated approach for the entire region. Differences in budget, economic sector predominance, lack of staff and the MSFD short time-scale are identified as the factors that can hamper cooperation. These have produced recommendations of possible strategies for optimising regional coordination structures which respect the subsidiarity principle underpinning the MSFD.  相似文献

Implementation of marine ecosystem-based management requires improved understanding of existing governance, including gaps and overlaps resulting from fragmented management. Focusing on overlaps, this paper presents a technique using text analysis to assist in the identification of agencies and laws involved in overlaps from a system perspective. The overlaps analysis uses term frequency counts on ocean laws and regulations in conjunction with relevant agency authority. Such information delivered in a transparent user-friendly presentation can help policymakers and other constituents of ecosystem-based management to find existing overlaps as a step to facilitate improved coordination.  相似文献

It is increasingly accepted that humanity’s unsustainable use of the marine environment is causing the degradation of the very marine ecosystems it relies upon. This awareness had led to the generation of a significant number of international agreements and conventions aimed at improving marine management and conserving marine ecosystems. In the European Union, this has resulted in the evolution of an extensive array of environmental legislation and policy. In addition, the United Kingdom and its devolved regions have been developing their own policies and legislative tools to advance marine conservation and management. Party to all of these tiers of governance, Northern Ireland has made numerous international, regional and national commitments to protecting and restoring marine ecosystems. Here those commitments are explored in terms of the local political, administrative and governance reality in Northern Ireland. A complex governance structure and lack of interdepartmental co-operation is shown to severely hinder Northern Ireland’s ability to meet stated commitments. Underfunding and lack of political will also seriously hamper conservation efforts. Findings indicate that the integration of all marine management functions into a single marine management organisation would greatly facilitate Northern Ireland’s progress and that the development of an ecologically coherent network of marine protected areas would go a long way towards fulfilling its conservation commitments. This case study demonstrates some of the hurdles small nations face in meeting their responsibilities under regional and international agreements and highlights the gap between a nations conservation commitments and its successful implementation of policy to fulfil them.  相似文献

This study examined how the United States’ National Oceanic and Atmospheric Administration (NOAA) has begun to implement and change its management strategy towards one of an ecosystem approach to management (EAM). In 2005, surveys were conducted with NOAA scientists and resource managers in nine NOAA programs in eight geographic regions across the United States. We quantitatively examined temporal and spatial trends in NOAA's EAM project implementation. Through a qualitative analysis of the data, we identified important lessons learned, best practices, and challenges of NOAA EAM projects. A content analysis identified three of the most frequently provided “success strategies” and include: (1) encouraging collaborations, (2) utilizing multidisciplinary approaches, and (3) identifying common priorities among constituents. We conclude with recommendations for initiatives that NOAA, and others interested in EAM, can undertake to facilitate further ecosystem management opportunities.  相似文献

Over the years, the breadth and depth of EU marine policy has increased with revisions of the Common Fisheries Policy (CFP) and new legislation like the Marine Strategy Framework Directive (MSFD), Integrated Maritime Policy (IMP) and the Framework for Marine Spatial Planning Directive in Europe (FMSP). Not only do these different policies have different remits and hence scope, they also present a multitude of modes of implementation. Although the CFP and MSFD have many common goals when it comes to conservation and sustainable use of living marine resources, they differ substantially in governance set up and implementation modalities, including the underlying scientific advisory processes and structures. Regional cooperation and coordination is foreseen, but there is no governance model in place to coordinate requests for scientific advice, nor institutions coordinating the activities of advice providers, either across policies or across regions. This results in an increase in uncoordinated requests for scientific advice yet the pool of experts fuelling the advisory system is limited. As a result the European marine scientific advisory system is increasingly under pressure. In this paper the consequences of this problem are analysed and a redesign of the institutional governance setting to accommodate these challenges and make the science and advice system ready for the future is explored.  相似文献

Notwithstanding the wide range of actions taken to strengthen the legal regime of international fisheries, overexploitation and the risk of depletion of stocks have been strong concerns for decades. Indeed, the regime of international fisheries law is currently not rooted in sustainability, and it does not adequately take into consideration the impact of fishing activities on the wider marine environment. One of the main causes lies in fragmentation of international fisheries law: a lack of coordination between instruments and institutions, and gaps in effective coherent structures for fisheries management. Areas beyond national jurisdiction (ABNJ), including the high seas, are particularly prone to this lack of coordination and integration.One alternative to reach a durable management of high seas fisheries might be found in a ‘global oceans governance approach’. This paper explores how this approach could impact the fragmented regime of fisheries. It suggests that governance-based perspectives underline concepts rooted in adaptability and interactions, concepts that suggest to approach international fisheries law not as a static set of rules but as an evolutive process. Reflecting on an overarching goal of coordination and possible management challenges in ABNJ provides an interesting starting point to develop a comprehensive understanding of the impacts of oceans governance on the fragmented legal regime of high seas fisheries. We now need to see how to give effect to governance, a task that remains, at this point, a work in progress.  相似文献

There are considerable efforts by governments, non-governmental organizations (NGOs), and academia to integrate marine conservation initiatives and customary practices, such as taboos that limit resource use. However, these efforts are often pursued without a fundamental understanding of customary institutions. This paper examines the operational rules in use and the presence of institutional design principles in long-enduring and dynamic customary fisheries management institutions in Papua New Guinea, Indonesia, and Mexico. Rather than a “blue print” for devising long-enduring institutions, this study relies on the design principles as a starting point to organize an inquiry into the institutional diversity found in customary governance regimes. Three important trends emerged from this comparative analysis: (1) despite it being notoriously difficult to define boundaries around marine resources, almost 3/4 of the cases in this study had clearly defined boundaries and membership; (2) all of the customary institutions were able to make and change rules, indicating a critical degree of flexibility and autonomy that may be necessary for adaptive management; (3) the customary institutions examined generally lacked key interactions with organizations operating at larger scales, suggesting that they may lack the institutional embeddedness required to confront some common pool resources (CPR) challenges from the broader socioeconomic, institutional and political settings in which they are embedded. Future research will be necessary to better understand how specific institutional designs are related to social and ecological outcomes in commons property institutions.  相似文献

Spatial boundaries have become an indispensable part of regimes and tools for regulating fisheries, with examples including marine protected areas, regional fisheries management organizations and Exclusive Economic Zones. Yet, it is also widely acknowledged that boundaries are a social construct, which may be resisted by both fishers and fish ecology. The ensuing spatial and institutional mismatches have been shown to frustrate management efforts, exacerbating issues of non-compliance and ultimately leading to conflicts and overfishing. Interestingly, the often static and rigid nature of these boundaries has also led to a concomitant research interest in ‘transboundary’. This paradoxical situation of more boundary-setting entailing more transboundary thinking warrants a deeper understanding about boundaries and the role of transboundary research in fisheries. The aims of this review article are twofold: (1) a theoretical clarification on the meanings and uses of spatial boundaries drawing on geographical “boundary studies” literature; and (2) a construction of a typology that outlines how transboundary research is being articulated and envisioned. Together, the study reveals that transboundary scholarship in fisheries are mostly related to resources, fleets, trade and governance aspects and that dealing with the “boundary paradox” encompasses re-incorporating, re-scaling and re-imagining of boundaries. This article provides a conceptual basis for reflecting upon boundaries in world's fisheries and opens up discussions for a more nuanced boundary application that can better cope with multi-level interactions and dynamicity.  相似文献
