Notwithstanding the wide range of actions taken to strengthen the legal regime of international fisheries, overexploitation and the risk of depletion of stocks have been strong concerns for decades. Indeed, the regime of international fisheries law is currently not rooted in sustainability, and it does not adequately take into consideration the impact of fishing activities on the wider marine environment. One of the main causes lies in fragmentation of international fisheries law: a lack of coordination between instruments and institutions, and gaps in effective coherent structures for fisheries management. Areas beyond national jurisdiction (ABNJ), including the high seas, are particularly prone to this lack of coordination and integration.One alternative to reach a durable management of high seas fisheries might be found in a ‘global oceans governance approach’. This paper explores how this approach could impact the fragmented regime of fisheries. It suggests that governance-based perspectives underline concepts rooted in adaptability and interactions, concepts that suggest to approach international fisheries law not as a static set of rules but as an evolutive process. Reflecting on an overarching goal of coordination and possible management challenges in ABNJ provides an interesting starting point to develop a comprehensive understanding of the impacts of oceans governance on the fragmented legal regime of high seas fisheries. We now need to see how to give effect to governance, a task that remains, at this point, a work in progress.  相似文献

This article examines China's distant water fishing industry, with a focus on China's bilateral fisheries access agreements in Africa. The article argues that China largely conforms to international norms and rules on sustainable fisheries, but that challenges remain in efforts to work with China on the sustainable management of fish stocks. Developed countries contribute to China's policies and behavior in international fisheries in both positive and negative ways.  相似文献

Since the 1960s Taiwan has been a significant player in the global distant water tuna fisheries (DWTF). However, Taiwan's lack of political recognition has led some fisheries businesses to employ less conventional methods including Flags of Convenience (FOCs) in harvesting tuna resources. Meanwhile, Taiwan has been experiencing the painful cost of readjusted DWTF policies. This paper compares the readjusted policies in accordance with international management instruments and tuna compliance requirements (Compliance Agreement and UNFSA) and domestic laws are already undergoing adjustments to take these into account. This again demonstrates Taiwan's unique position in the international community: despite it not being a member of the United Nations, Taiwan spares no effort to ensure the sustainability of marine resources, and does its utmost to fulfill the responsibilities and duties of a Flag State.  相似文献

Stimulus to reach the millennium goals of poverty abatement and empowerment, including education and employment, for the large part of the population in the coastal zone can be found in the resources and services of oceans and coasts; the required financial means, given political will and right priorities, can be provided through implementation of the related international conventions, in particular UNCLOS with the EEZ, the Common Heritage of Mankind and other provisions, Agenda 21 [1] of UNCED and the WSSD 2002 Ocean Targets; the motivation is the necessity to address over-exploitation, depletion and destruction of resources, habitats and coastal ecosystem services, global changes, as well as economic transformations and social conditions of poverty, employment and unequity. Achieving adequate management and protection of natural assets as ecosystems and their services, habitats, biodiversity requires that the socio-economic and human security needs of the coastal populations are met. One way to reach the goal is to enable them, representing about 50% of the global population and increasing, to fight poverty and cope with uncertainties and changing conditions of employment, environment and sustainability through proper governance of the coastal and ocean assets. This includes provision of education and knowledge as regards these assets and their proper uses. They include energy, water, food, transportation and trade, communication, coastal developments, tourism, recreation and ecosystem services, as well as the need to properly manage them.The present economic system cannot fully harmonize with the required governance, partly since the ecosystem resources and services are not internalised in the market-oriented system. This calls for a revised education and training system, more comprehensive than the present, taking into account the social, cultural and environmental requirements, and stressing the sustainable development paradigm. In order to achieve ocean governance and comprehensive human security an understanding of the system is needed. This is substantiated through the Decade of Education for Sustainable Development as well as the Millennium Ecosystem Assessment.The aim here is to discuss some of the issues in context of implementation of related ocean conventions and commitments, which include achieving ocean governance, and to elucidate opportunities given by oceans and coasts, also in generating employment and providing for basic human needs.  相似文献

Increasing attention by consumers to the social and environmental dimensions of the food they eat has generated many different responses, including certification programs, watch lists and local/slow food movements. This article examines the more recent entry of seafood into these consumer social movements. Although a concern with the family farm—as well as tendency to equate national security with food security—has long connected terrestrial food production with other cultural concerns, fisheries have tended to be regarded more as natural resources. Considering seafood as part of the “food system” would enhance the management of fisheries, while the long engagement in fisheries with co- and adaptive management and the politics of knowledge would enrich the debate in the agri-foods literature. The article also offers suggestions on how fisheries management could better govern for sustainable food systems, and provides further ideas about food, sustainability and governance.  相似文献

There is a growing argument that the biological priorities of Europe's Common Fisheries Policy – to halt the depletion of commercial fish stocks – are not a straightforward solution to the problems currently facing international fisheries management and that social objectives need to be incorporated into policy. However, existing notions of fisheries ‘dependency’ and ‘community’ remain poorly understood and leave decision-makers struggling to address social and cultural issues. By investigating further concepts of ‘dependency’, ‘community’ and some of the social issues facing Fisheries Dependent Areas in Scotland, this research explores the complex shape of coastal fishing communities and the conditions of dependency on fishing that coastal areas face. In this paper preliminary findings from an in-depth case study of Fraserburgh in the north east of Scotland are presented to explore the potential meaning and justification of social objectives in fisheries policy.  相似文献

Almost 50 yr of global multispecies harvests are represented in the FAO capture production database, and offer a broad perspective on events that underlie the major observed changes in global marine harvests. The likely relevance of top–down and bottom–up trophic interactions, versus the impacts of changes in fishing technology and markets on the trophic level of landings, are discussed on a regional basis. Despite the low resolution of this global data set, several common features emerge. Rapid increases in fleet size and technological advance, and imperfect fisheries management measures, are probably responsible for declines in peak multispecies production in many areas since the 1970s, and internal evidence suggests that peak production is not far away in the remainder. Staggered dates of peak landings in different world areas seem to reflect the spread of industrial fishing fleets from `core areas’ to the rest of the world's oceans, which largely took place from the 1960s to 1990s. A general move to higher exploitation of piscivores in global landings is implied in some areas. The hypothesis that top–down removal of predators is affecting lower trophic production is however only one explanation for declining mean trophic levels, and is more likely to emerge from local food web studies. In some regions an increased proportion of short-lived invertebrates in harvests later in the time series supports a move downwards in trophic level targeting. In the North Atlantic and some other areas, fishing down marine food webs may be a likely cause of the increase in landings of shelf planktivores. A shift from depleted apical resources to species lower in the food web may have been made on economic grounds however, independent of possible effects of a release of predatory pressure. Sharp increases in planktivores later in the time series show up in the Eastern Central Atlantic and in the Southeast Pacific and do not appear to be primarily related to depletion of predators. They seem to reflect intermittent strength of upwelling systems, and hence bottom–up effects on food web production, together with changes in harvest technology. For some areas, piscivore landings increased later in the time series than those of planktivores. In the Mediterranean, this seems mainly a bottom–up response to increased marine productivity associated with land run-off and consequent improvements in predatory foraging. In some tropical areas, later increases in piscivorous landings mainly result from expansion of distant water tuna fleets, and are probably unrelated to exploitation of forage fishes. The technological revolution of the 1950s and 1960s involved rapid application of synthetic fibres to improved gear. This led to large-scale mid-water trawling and purse seining by industrial fleets and has especially increased vulnerability of small pelagic stocks over the last few decades. This appears mainly responsible for the apparent decline in mean trophic level of harvests in areas with large stocks of these resources. From an analysis of variances of the sample data set, `Punctuated equilibrium', involving actual changes in ecosystems, rather than just continuous change in the relative harvest rates of species in a given ecosystem, is suggested as an important phenomenon, reflecting both ecological change and changing exploitation strategies.  相似文献

One of the main challenges of international environmental agreements is improving relevant policy actions to promote adequate environmental responses. To support the work of decision makers, recent studies have used environmental and social indicators to construct global and regional-scale indices. This study aimed to use the Ocean Health Index and the Management Ranking for Brazilian States to assess Brazil’s performance regarding the Aichi Biodiversity Targets (ABTs) for coastal and marine ecosystems. Thus, six ABTs were matched and their performance was evaluated. These ABTs focused on the following topics: pollution, fish and invertebrate stocks, pressures on coral, threatened species and their conservation, the contribution of biodiversity to carbon stocks and the national biodiversity strategy and action plan. However, although the indices used showed many pathways to explore how Brazil is performing, it is still complex to evaluate ABTs’ performance regarding coastal and marine ecosystems at a global and regional scale.  相似文献

Assuming a broad set of fisheries management goals, this paper analyzes the implementation of a marine protected area (MPA) together with open access outside, applying a bioeconomic model that ensures unchanged growth post-MPA. Taking into account that conservation and restoration, food security, employment and social surplus are amongst the objectives that many managers include in fisheries management, it is found that this broader welfare economic approach to MPAs may well recommend them to a greater degree than espoused in the more common resource rent focused studies carried out to date. It is shown that for overfished stocks, an MPA may yield resource protection, maximize harvests and increase consumer and producer surplus, as well as give higher employment. This, however, is less apparent for moderately overfished as well as highly migratory stocks. Resource protection and enhancement implicitly improves ecosystem services.  相似文献

综述了国际上有关海洋浮游动物种群、群落结构、多样性及浮游动物对全球气候变化响应等方面研究进展。海洋浮游动物种类繁多, 数量丰富, 分布广泛, 是海洋生态系统中最重要的生物类群。在海洋食物网中, 浮游动物通过摄食浮游植物控制初级生产力, 同时, 又被更高营养阶层的动物(鱼、虾、鲸、海鸟等)捕食, 充当次级生产者的角色, 其群落结构、种群动态和物种多样性影响鱼类和其他海洋动物资源量, 浮游动物是海洋食物网中关键环节。海洋生态系统动力学过程的关键环节是浮游生物的生物学和生态学过程, 多项国际研究计划以生物多样性和年际变化趋势为研究重点并联系全球变化及响应, 因此, 浮游动物的研究已成为海洋生态研究的核心内容之一。国际上对浮游动物的研究主要集中在以下6个方向:(1)浮游动物生境、种群的分布和扩散动力学研究;(2)浮游动物的群落结构和多样性;(3)浮游动物的实验生态和现场受控生态研究;(4)浮游动物对全球气候变化的响应;(5)深海、南北极、低氧区等极端生境的浮游动物生态学研究;(6)浮游动物研究新技术和方法。  相似文献

Cooperation is one of the cornerstones of the international fisheries regime. It requires States to work together for the conservation and management of the fisheries resources. This applies even stronger with respect to shared fisheries resources. However, negotiating a cooperative solution is not always easily achievable for the parties involved and the international regime does not provide for consequences in such cases. Faced with such a problem and seeking a new solution to it, the EU adopted Regulation 1026/2012, equipping itself with a framework for adopting measures against third countries. This innovative solution challenges certain aspects of the international duty to cooperate and its negotiations aspect. The EU's innovation has so far failed because it lacks clear international support and basis in the international regime. This failure exemplifies one of the limits of unilateralism for generating developments in international fisheries law.  相似文献

Marine capture fisheries face major and complex challenges: habitat degradation, poor economic returns, social hardships from depleted stocks, illegal fishing, and climate change, among others. The key factors that prevent the transition to sustainable fisheries are information failures, transition costs, use and non-use conflicts and capacity constraints. Using the experiences of fisheries successes and failures it is argued only through better governance and institutional change that encompasses the public good of the oceans (biodiversity, ecosystem integrity, sustainability) and societal values (existence, aesthetic and amenity) will fisheries be made sustainable.  相似文献

Long-term investment to drive the adoption of precautionary, adaptive and resilience-building fisheries management measures is urgently required, especially given the financially difficult transition period to reach sustainable fisheries. In this paper a case for investing in the recovery of large marine ecosystems is provided based on the future value of recovered fish stocks. It is argued that the current market-based sustainable seafood movement alone will not affect the scale of change needed and must be complemented by investment in fundamental conservation measures that will lead to the recovery of marine ecosystems and promote long-term sustainable use. A rationale for addressing the economically challenging transition period is provided and the basis of a new financial institution to finance the measures necessary for realising the economic, social and environmental benefits of large-scale fisheries reform is proposed.  相似文献

Many fish stocks in the world are depleted as a result of overexploitation, which reduces stock productivity and results in loss of potential yields. In this study we analyzed the catch trends and approximate thresholds of sustainable fishing for fished stocks to estimate the potential loss of catch and revenue of global fisheries as a result of overexploitation during the period of 1950–2010 in 14 FAO fishing areas. About 35% of stocks in the global marine ocean have or had suffered from overexploitation at present. The global catch losses amounted to 332.8 million tonnes over 1950–2010, resulting in a direct economic loss of US$298.9 billion(constant 2005 US$).Unsustainable fishing caused substantial potential losses worldwide, especially in the northern hemisphere.Estimated potential losses due to overfishing for different groups of resources showed that the low-value but abundant small-medium pelagics made the largest contribution to the global catch loss, with a weight of 265.0 million tonnes. The geographic expansion of overfishing not only showed serial depletion of world's fishery resources, but also reflected how recent trends towards sustainability can stabilize or reverse catch losses.Reduction of global fishing capacity and changes in fishery management systems are necessary if the long-term sustainability of marine fisheries in the world is to be achieved.  相似文献

As increasingly large extents of the global oceans are being managed through spatial measures, it is important to identify area characteristics underlying network distributions. Studies discerning spatial patterns in marine management have disproportionately focused on global networks. This paper instead considers the single country context of Japan to illuminate within-country drivers of area-based conservation and fishery management. A dataset containing potentially relevant socioeconomic, environmental, and fisheries factors was assembled and used to model prefecture-level counts of marine protected areas (MPAs) and territorial use rights for fisheries (TURFs) throughout Japan's waters. Several factors were found to significantly influence the number of TURFs in a particular area, whereas MPA patterns of use remain largely unexplained. TURFs are frequently noted as more suitable for managing fisheries of low mobility species and our analysis finds greater use of TURFs in areas that rely heavily on benthic catch. The number of trading ports was also found to be positively related to TURF distributions, suggesting economic infrastructure may influence the use of this fisheries management tool. In-line with global analyses, MPA patterns of use were not found to be significantly related to any of the potential explanatory variables after correcting for the number of statistical comparisons that were carried out. Differences in our ability to model the use of TURFs and MPAs may arise due to the narrower objectives associated with the former (e.g., income, employment) in comparison to the often broad and varied goals that motivate use of the latter.  相似文献

Marine fisheries play an important role in the economy of Sierra Leone, supporting livelihoods and contributing significantly to food security. This paper looks in detail at how the performance of fisheries was impacted by the ten year civil war, an event which contributed to the country's reputation for being a “failed state”. The paper focuses mainly on the artisanal fisheries sector, which employs the majority of the country's coastal population, and demonstrates how the conflict caused major social dislocation to fishing communities as well as reducing the productive capacity of the fleet. The paper concludes with a discussion of the policy challenges now facing Sierra Leone, particularly the prevention of resource looting through illegal fishing of the offshore stocks and the development of strategies to enable the potential wealth of these fisheries to be captured.  相似文献

Overfishing is a major problem in global fisheries, plaguing 32% of stocks around the world and a massive 72% in the EU. Despite this, access to public fish resources in the EU and its member states are granted without any social or environmental conditions. Without these, the process of allocating quotas – essentially determining the future health of marine resources and the fishing industry – is blind to virtually all of the impacts of fisheries. Here, the United Kingdom's North Sea cod fishery is studied, comparing the social, environmental and economic impacts of trawlers and gillnets, the two major fishing gears targeting cod in this area. Comparisons are also made on a vessel-length basis to address recent debate concerning the benefits of small-scale fisheries. The results show that, for each tonne of cod landed in these fisheries, all trawlers have impacts that are more costly than the value of their landings. There are also vessel length-specific differences, with the largest trawlers the most destructive (−£1992/tonne and −£2.50/fish). Gillnets, on the other hand, generate positive value to society (+£865/tonne and +£2.16/fish). Despite these impacts, gillnets land only 1% as much cod as trawlers do. The results support the policy implementation of access criteria into the reform of the Common Fisheries Policy, to ensure fishermen generate positive outcomes for society and to provide incentives that align fishermen's interests with conservation objectives.  相似文献

The Falkland Islands Government has established a transferable rights management regime for its fisheries resources. The allocation of transferable rights has to be sensitive to economic and social considerations specific to the Falkland Islands. One critical requirement is the need to balance local ownership and control with the need for direct foreign investment and the continued involvement of foreign fishing fleets in the territory's fisheries. Several mechanisms to achieve this balance are contained in recent fisheries legislation. These mechanisms will be of interest to other small island territories facing similar challenges in their commercial fisheries.  相似文献

Colombia has coasts on both the Atlantic and Pacific Oceans, but its marine fisheries are limited by the relatively small size of commercially important stocks. However, diverse fishery resources have traditionally been exploited by coastal communities, and industrial fisheries have grown in recent years with the intensification of tuna fishing in both oceans. The management of Colombia's fisheries has been hampered by frequent administrative changes, which has notably led to the disappearance of a part of the official landings data. We estimated total fisheries removals (reported plus discards and unreported catches) in the Colombian Atlantic and Pacific Oceans for the period 1950–2006. We used secondary sources of information to estimate missing data, and we estimated subsistence fishing and the unreported by-catches of the shrimp and tuna fisheries. We used available information on seafood prices to estimate the relative economic impact (gross revenues) of the small-scale and industrial sectors for the period 2000–2006. Our results suggest that for the period 1950–2006, the Colombian marine fisheries catches may have been almost twice the landings reported by FAO on behalf of the country (2.8 times higher in the Atlantic; 1.3 times higher in the Pacific). Although the total gross revenues of industrial fisheries were higher than those of the small-scale sector, the latter commanded higher gross revenues in the Atlantic in 2006.  相似文献
