The law of the sea has always been open to the charge of being a ‘covenant without a sword’ and its effectiveness when challenged by the perceived national security of a superpower is questionable. Attempts to limit and control antisubmarine warfare (ASW) have demonstrated that neither superpower is prepared to risk its second-strike capability for what may be an illusory legal protection. This article reviews developments relevant to ASW in the law of the sea and describes the significance of ASW to the superpowers' strategic objectives. 文章探讨科学与法学意义上自然资源概念的差异,聚焦自然资源法在自然资源开发、利用、管理、保护等领域的规制本质与主要特征。当前国内外对自然资源法内涵与外延的看法不尽一致,但自然资源法中的“通用性”内容却是稳定存在的,这有助于在理论和实务中理解和运用自然资源法;与自然资源直接相关的法律规范,都应该或可以归入自然资源法范畴;应当根据具体适用领域,区分自然资源法的广义概念与狭义概念;自然资源法奉行一定的价值标准,必须考虑发展价值与保护价值之间的动态平衡或阶段性侧重;应科学推进自然资源法治建设,加快自然资源治理体系和治理能力现代化进程。 相似文献

Under the Pacific Patrol Boat (PPB) program, Australia has supplied twenty-two 31.5 m patrol boats to 12 island countries in the South Pacific. While the primary task of these boats is fisheries protection, they have also been used for a range of other national tasks, including search and rescue, medical evacuations, hydrographic surveying, anti-smuggling and sovereignty patrols. As well as the boats themselves, the program comprises resident maritime surveillance and technical advisers, crew training and through-life logistic support. The PPB program has proven to be highly successful with the benefits of the program exceeding those originally sought by the Australian Department of Defence in establishing the program. 相似文献

‘Offshore CO2 storage’ refers to the injection of liquefied CO2 into deep geological formations beneath the seabed (e.g. depleted oil and gas reservoirs, and saline aquifers) for the purpose of storing it there on a permanent basis. The storage in this manner of captured CO2 emissions from industrial installations and power plants has attracted considerable scientific and technical interest as a potential mitigation response to climate change. A key issue facing policymakers in several countries is how to reconcile policy commitments to develop offshore CO2 storage with other competing – and potentially conflicting – uses of the marine environment. With a view to informing policy responses to this issue, this paper presents a case study of legal and policy frameworks concerning offshore CO2 storage in United Kingdom. The paper maps key design features of the United Kingdom׳s framework for marine permitting and planning, appraising the extent to which they enable orderly development of offshore CO2 storage in a manner consistent with relevant high-level policy objectives. 相似文献
