Fisheries observers can both collect scientific data and report on compliance with fisheries regulations. Observers are used only for scientific purposes in most US fisheries. However, North Pacific groundfish fisheries observers are required to report violations of fisheries regulations that they witness. Based on evaluation of historical enforcement incidents and survey data, this paper considers the effects of mandatory reporting in the North Pacific. The goal of this analysis is to determine whether and how observer enforcement in the North Pacific differs from observer enforcement in other US fisheries and to determine what benefits observer enforcement might yield if adopted in other fisheries.  相似文献

In the southeastern Bering Sea, Pacific herring (Clupea pallasii) migrate from the Pribilof Islands region where they overwinter, to the Alaska coast where they spawn in spring. The migration sustains a nearshore commercial fishery that targets roe-bearing females just prior to spawning. Herring also are taken as bycatch in groundfish trawl fisheries, where time and area closures in these fisheries are triggered by herring bycatch caps. Using herring bycatch data collected since the 1970s by National Marine Fisheries Service (NMFS) observers aboard groundfish fishing vessels, a retrospective analysis was conducted to describe the seasonal migration pattern of Pacific herring in the southeastern Bering Sea and to study its spatial and temporal variability. Observed changes in herring catch per unit of effort were compared with variability in climate and oceanographic conditions. The seasonal migration is complex, but annual shifts in migration routes and a possible northward shift of the overwintering grounds was identified. Pre-spawning herring aggregated in different areas depending on whether spawning occurred early or late in spring. The thermal structure of the ocean around the ice edge appears to influence herring migration timing and route as well as spawning date. Thus, on the basis of recent changes in sea-ice extent and duration, we suggest that the herring bycatch savings area that was developed from data collected in the 1980s should be revised to reflect prevailing conditions.  相似文献

The Magnuson-Stevens Fishery Conservation and Management Act (1976), opened a new era of federal fishery management in the United States. It was enacted primarily to establish a system for conserving and managing fisheries in the new 200-mile (EEZ). The US assumed exclusive authority for managing all fisheries within the EEZ, except for highly migratory species such as tunas and billfishes. Within the framework of the Act, eight Regional Fishery Management Councils (Regional Councils) were created, which are responsible for preparing Fisheries Management Plans (FMPs) in federal waters under their jurisdiction. Each FMP must meet a series of National Standards (NSs) for conservation and management. The Act was reauthorized in 1996 with the passage of the Sustainable Fisheries Act (SFA), which aimed at fine tuning the fishery regulatory apparatus that was established under the original Act. This "fine tuning" involved increased attention to biological concerns, and removal of ambiguities within it. The Act was reauthorized again in 2007, mainly to provide for more clear directives and regulations to end overfishing. After more than thirty years since the Act was passed into law, the debate among conservationists, commercial and recreational fishery representatives, and politicians on the effectiveness of the Act in achieving its purported goals it still continues. Is the Act delivering on its promises? Do NSs reflect the most important priorities for the US fishery resources, conservation and sustainable exploitation? Do the Regional Councils represent all parties that should be involved in the fisheries resources management? The aim of this paper is to provide a critical analysis to answer these questions. This paper begins with a review of the Act and its background, followed by discussion and analysis of the Act's benefits and flaws. Finally, suggestions for the implementation of its structure and future directions in fishery management strategies are made.  相似文献

The Magnuson–Stevens Act is the United States׳ premier law governing fisheries conservation and management. Congress has revisited the Act multiple times since its inception in 1976—most recently in 1996 with the Sustainable Fisheries Act and in 2006 with the Magnuson Stevens Act—and is currently in the process of reauthorizing the Act. The University of Washington focused the 14th annual Bevan Series on Sustainable Fisheries on issues surrounding reauthorization. The symposium featured a diversity of stakeholders, including fisheries scientists, managers, policy analysts, students, non-governmental organizations, Tribes, and industry. The symposium explored the Act׳s history, means of ending overfishing and ensuring accountability, lessons from U.S. West Coast and North Pacific fisheries, and challenges and solutions to ecosystem-based fisheries management.  相似文献

In the first article below, A.M. Olsen, former Director of Fisheries, criticizes the Chattertons' conclusions, maintaining that fisheries should be managed by professionals not politicians and that many of Brian Chatterton's problems during his tenure as Minister of Fisheries were of his own making. In the Chattertons' response, they point out that by allocating management of the resource between various vested interests (including government bureaucracy) a minister is making a political decision. In the third article, R.D. Walkerden, a former Permanent Secretary to Fisheries Ministers in South Australia, offers an administrator's view of the controversy. An important component of science-based fisheries policy is the provision of habitat adequate for population renewal. In Canada, the Fisheries Act pays little attention to managing fish habitat, and was further weakened by changes enacted in 2012. Specifically, determining the role of fish habitat in contributing to fisheries and fish stock recovery is challenging when many stocks have severely declined and no longer occupy former habitats. This study compared the abundance of juvenile fish in coastal vegetated habitats before and after collapse or decline of groundfish stocks in Atlantic Canada. This comparison was done by compiling past studies that surveyed juvenile Atlantic cod (Gadus morhua) and pollock (Pollachius virens) in vegetated habitats across three provinces. Two studies were repeated, and one that already had post-collapse data was analyzed to quantify long-term changes in juvenile abundance. In all three cases substantial reduction in juvenile abundance coincided with declines in adult stocks. However, juvenile fish still occur in coastal habitats and could aid in adult stock recovery. The current version of the Canadian Fisheries Act requires presence of an ongoing fishery to trigger habitat protection. This is problematic as low fish abundance may lead to lowered habitat protection and potentially habitat degradation, with less or lesser-quality habitat for fish in the future. Thus, recommendations are made to repeal the 2012 Fisheries Act changes and enhance current fish habitat legislation. Using a precautionary approach for coastal fish habitat management, particularly in valuing its potential for fish stock recovery, would strengthen Canadian fisheries management.  相似文献

Emerging fisheries and changes in fishery practices are not always readily apparent, nor are their impacts on non-target species such as seabirds, sea turtles, and marine mammals. Data from several different sources led managers to discover high rates of sea turtle bycatch in an inshore large-mesh gillnet fishery in North Carolina, USA, particularly the emerging deep-water gillnet fishery. This paper reviews the history of how increased numbers of observed stranded sea turtles in 1999 led to the discovery that turtles were becoming entangled in the large-mesh gillnet fishery in Pamlico Sound, North Carolina. It also demonstrates how a variety of data sets from fisheries observers, aerial surveys, and fisheries statistics programs contributed to shaping management of the large-mesh gillnet fishery in Pamlico Sound to decrease turtle bycatch and now point towards the need of additional assessment of gillnet bycatch in other parts of North Carolina. Finally, potential approaches are discussed for a more timely detection of future fishery conflicts and development of a plan to reduce otherwise inevitable bycatch and disruptions to fishing effort.  相似文献

Fleet communication systems report near real-time observations of bycatch hotspots to enable a fishery to operate as a coordinated “One Fleet” to substantially reduce fleet-wide capture of protected bycatch species. This benefits the bycatch species per se, reduces waste, and can provide economic benefits to industry by reducing risk of exceeding bycatch thresholds and causing future declines in target species catch levels. We describe case studies of fleet communication programs of the US North Atlantic longline swordfish fishery, US North Pacific and Alaska trawl fisheries, and US Alaska demersal longline fisheries, and identify alternative fleet communication program designs to reduce fisheries bycatch. Evidence supports the inference that these three fleet communication programs substantially reduced fisheries bycatch and provided economic benefits that greatly outweighed operational costs. Fleet communication may be appropriate in fisheries where there are strong economic incentives to reduce bycatch, interactions with bycatch species are rare events, adequate onboard observer coverage exists, and for large fleets, vessels are represented by a fishery association.  相似文献

The last 20 years have seen a fundamental shift in fishery management from reliance on open access and regulated open access to systems based on individual user rights. In some cases, the allocation of harvest rights to defined harvest or community sectors has served as a catalyst to drive the formation of voluntary agreements among fishermen in creating self-governed systems of catch shares. A number of voluntary cooperatives including the Pacific Whiting Conservation Cooperative – which served as the model for the American Fisheries Act – provide examples of self-governing systems which have successfully achieved management objectives including greater economic performance, equity, and conservation. Cooperative arrangements have functioned to devolve some of the responsibilities of management to the cooperative – allowing fishermen greater operational flexibility in achieving individual or community goals, while reducing the burden of management on formal managing bodies. Analysis of voluntary cooperatives shows that their success is based on the existence of certain core conditions including relatively small homogeneous groups of players, secure sector-allocated and divisible rights, and the ability to form binding contracts among coop members. Cooperatives, however, face a number of internal and external threats that can undermine their success and existence. Whether voluntary or designed through regulation, cooperatives may be a promising approach for addressing challenges in non-industrial fisheries in the United States including the Western Pacific – especially if coupled with user rights based on geography, territory, and culture. However, the sheer geographical size and cultural diversity of regions such as the Western Pacific suggests that no single approach may be appropriate throughout the entire region.  相似文献

This paper examines the sustainability of United States fisheries managed under the Magnuson-Stevens Fishery Conservation and Management Act, the law that provides the framework for federal fisheries management. Sustainability across a broad suite of criteria, including health of the fished stock, bycatch, and effects on the habitat and ecosystem, was measured against the Monterey Bay Aquarium׳s Seafood Watch criteria for ecological sustainability. Seafood Watch ratings and numerical scores for U.S. federally managed fisheries were analyzed to elucidate strengths and weaknesses among federally-managed fisheries. Of U.S. federally managed fisheries assessed by Seafood Watch, only 2% are rated “Avoid”, and strong ratings for stock health for nearly all fisheries indicate that the Magnuson-Stevens Act is fundamentally succeeding at maintaining or rebuilding the abundance of targeted stocks. The majority (79%) of U.S. fisheries earn the intermediate rating of “Good Alternative”, and 19% earn the top rating of “Best Choice”. Given that U.S. fisheries management is considered among the strongest in the world, this analysis assesses why the majority of U.S. fisheries are not rated “Best Choice”. Fisheries for all variety of species, and using a wide range of fishing methods, can merit “Best Choice” status. However, the majority of U.S. fisheries do not achieve this rating due primarily to bycatch concerns. By improving performance with regard to bycatch, most “Good Alternative” U.S. federal fisheries could reach “Best Choice” status and reap rewards in the marketplace for that recognition. Findings suggest that current science-based management should be maintained in the Magnuson-Stevens Act reauthorization, managers should adopt best practices based on fisheries that are already performing well in the U.S., and more specific federal bycatch mitigation requirements should be implemented.  相似文献

The main objectives of fisheries management are generally similar throughout the world. These are often stated in policy documents such as the Common Fisheries Policy and the Magnuson–Stevens Fishery Conservation and Management Act. However, at the local level often the key objectives of management are more detailed, characterised by both the overriding management structure and the status and type of fishery concerned. In this paper, we consider case study fisheries from the UK, France, Spain and Denmark to compare some of the various types of fisheries and fisheries management systems that exist in the European Union. Marine protected areas and marine reserves are being established in United States ocean waters under several federal and state laws. Relevant laws include the National Marine Sanctuaries Act, the Magnuson–Stevens Fisheries Conservation and Management, the National Monument Act, the federal Submerged Lands Act, and the California Marine Life Protection Act. This article evaluates U.S. place-based ocean management from the perspectives of relevant international law principles and programs and foreign nation experiences relevant to the U.S. It then focuses on the challenges presented in managing multiple uses of U.S. ocean waters in the face of federal and state jurisdictional complexity. The movement toward catch shares by NOAA Fisheries and fisheries managers worldwide responds to dysfunctional fisheries plagued by a host of interrelated problems including radically shortened seasons, a race to fish, supply gluts, lowered product quality, increased bycatch, safety issues, excess capacity, and lack of profitability. However, the NOAA Catch Shares Policy recognizes that catch shares are not appropriate for every fishery, and others have agreed that the success of catch shares programs depends on their fit with ecological, economic, and social characteristics. This article describes the characteristics of the Hawaii-based deep-set longline fleet, identified by NOAA Fisheries as a possible candidate for catch shares because it operates under a bigeye tuna quota instituted by the Western and Central Pacific Fisheries Commission. One of the main concerns in the fishery is the potential for closing during the holiday season, a culturally important time for fish consumption in Hawaii. An evaluation of the fishery suggests that many of the problems leading to development of catch shares programs in other fisheries are not present, but that some warning signs exist which could be addressed by catch share programs or other management alternatives.  相似文献

The Marine and Coastal Access Act 2009 is now enacted into law. This paper looks at predictions made about new law by one of the authors, Peter Jones, in his paper The Marine Bill: Cornucopia or Pandora's Box [1] and assesses how successful the Act has been in turning aspirations into law. The paper focuses on the following areas: ecosystem protection, stakeholder engagement, marine spatial planning and the provision of a network of highly protected marine reserves, and raises concerns that the ecosystem approach has progressively been dropped in the drafting process of the legislation. Concerns are raised that the new Inshore Fisheries and Conservation Authorities have similar inherent conflicts of interest to those exhibited by Sea Fisheries Committees, which they sought to replace. The effectiveness of marine planning is questioned, as there appear to be inbuilt loopholes for public authorities to avoid complying with the marine plans. The draft marine policy statement (MPS), published in July 2010, includes appropriate environmental safeguards, but the MPS has not yet been formally adopted. The absence of a concrete target for highly protected marine reserves means there is a danger that designations under the Act may have little effect on the ground. In conclusion the Act provides some new mechanisms for marine protection, but arguably does not yet provide a framework for implementing the ecosystem approach and is not an end in itself.  相似文献

The statutory closure of 60 square miles of Lyme Bay to towed fishing gear in 2008 marked the culmination of nearly 20 years of discussions between conservationists and fishermen. Prior to the 2008 decision, voluntary, bottom-up led agreements resulted in inadequate protection of the bay's biological resources and significant erosion of social capital. Lyme Bay provides an excellent case study of the challenges likely to be posed by wider stakeholder involvement imposed under the new Marine Act. This paper examines a broad range of perspectives in relation to the Lyme Bay consultation and subsequent closure, via semi-structured interviews with 25 representatives of different interest groups in Lyme Bay. All respondents acknowledged significant flaws in the process leading to the Lyme Bay decision and felt the Marine Act was well placed to tackle many of these criticisms. However, while the Marine Act should provide a framework for resolving conflicts, it will not prevent them. Success will depend on collaboration between different marine interests, and also on the government acknowledging that outcomes are unlikely to favour everyone in the short-term and that top-down interventions are inevitable.  相似文献

The Korean fisheries industry has long played a role as a national food industry with agriculture. Fisheries products supply about 39.2% of animal proteins that Korean people need. The industry, however, is facing great challenges including international arguments for reduction or abolition of fishery subsidies. Therefore, it is urgent for us to review the characteristics of fishery subsidies according to WTO, OECD, FAO and UNEP. This paper examines the status of Korean fishery industry, and to tackle the problems of the currently supported fishery policy funds, whose total amount in 1999 was more than 1 trillion Korean won with 77 fishery projects.  相似文献

Management strategies are challenging to implement in Zanzibar's fisheries because the local people depend upon these resources for basic subsistence. This difficulty epitomizes the vital need for sustainable management: the more people need a fishery, the harder it is to limit fishing to allow regeneration. Comparing fisheries management strategies in two coastal villages in Unguja, the largest island of Zanzibar, Tanzania, this paper confirms the results of existing scholarship that communitybased strategies provide the most promising solutions to this challenge. Interviews with officials from the Department of Fisheries and Marine Resources, Village Fishermen Committees, and 51 fishermen in the villages of Kizimkazi Dimbani and Jambiani reveal the efficacy of strategies where local fishermen are centrally involved. The fishermen interviews reveal ignorance of existing fishing regulations and a lack of enforcement while fishermen at both sites noted that many illegal methods of fishing are still in use and expressed concern that such methods damage fish stocks. The Village Fishermen Committees, a recently implemented community-based initiative, are well attended by fishermen, and constitute a management strength that this paper concludes should be the foundation of future policy. To be successful, these committees need additional educational and financial resources.  相似文献
