While the international community debates the desirability and possible content of a new global instrument for the conservation and sustainable use of marine biodiversity in areas beyond national jurisdiction, alternative approaches to improving the application and implementation of existing agreements for the protection of biodiversity appear to have fallen off the agenda. Recent practice under existing global and regional agreements suggests that, given political will, significantly greater protections could be achieved through the more effective implementation of individual sectoral agreements. However, while single-sector measures have the potential to make a valuable contribution, ultimately only multi-sectoral, integrated, cooperative management can ensure the conservation and long-term sustainable use of marine biodiversity in ABNJ. This requires establishing mechanisms for cooperation both intra and inter-sectorally, as well as between the sectoral and global and regional conservation agreements. This paper examines recent initiatives within various sectoral and conservation treaty regimes aimed at improving their application within ABNJ as well as some of the challenges to, and options for, further and better cooperation and coordination among and between existing regimes, and it identifies a range of possible mechanisms for achieving more effective implementation and coordination among them. Greater use of existing mechanisms represents a sensible approach to making the most of existing arrangements without in any way foreclosing the possibility of the adoption of a more comprehensive, integrated global agreement for the protection of marine biodiversity in ABNJ.  相似文献

United Nations discussions on the governance of marine areas beyond national jurisdiction have questioned, but not yet reached a decision, on whether existing institutional agreements and structures are sufficient to meet global commitments to protect marine biodiversity, or if additional mechanisms may be required. This paper considers two very different efforts to protect marine biodiversity in these areas: (1) in the North-East Atlantic through the efforts of OSPAR Convention for the Protection of the Marine Environment of the North-East Atlantic; and (2) in the central Atlantic, through the efforts of the Sargasso Sea Alliance led by the Bermuda government. In each case, action has been strongly supported by non-governmental organisations and subsequent progress has hinged upon on-going dedicated efforts of “champion” governments to bring other States on board. This paper outlines the difficulties that they have faced, and consequently why they have been time-consuming, and are not yet completed. The paper then considers 10 common recommendations that can be drawn from the experiences of these two distinct initiatives, and their relevance to on-going UN deliberations.  相似文献

The development of regional governance for the protection of the environment, sustainable use of natural resources and conservation of its biodiversity is unquestionably a cornerstone of international environmental law and policy. With regard to marine and coastal issues, it has mainly been taking place through Regional Seas programmes, Regional Fishery Bodies and Large Marine Ecosystems mechanisms. Based on a similar geographical approach, however, these regional mechanisms raise concerns relating to their coordination and efficiency, and possibly overlap in what they aim to achieve. This paper provides a review of existing regional oceans governance mechanisms, assessing their individual and collective capacities to move towards ecosystem-based management, and highlighting options to make the regional landscape more coherent and effective.  相似文献

The regionalisation of international environmental law has emerged as one of the most important legal trends of the last decades. However, the regulation of coastal management stood apart from this trend for a long time; indeed, while integrated coastal zone management (ICZM) projects have developed at all scales, legal regulation of ICZM has long been confined to the national and sub-national levels. This is not the case any longer: recent developments in ICZM implementation demonstrate an increasing interest in regional regulation through the adoption of specific protocols within regional seas frameworks. The article aims at taking stock of these recent initiatives, specially focusing on the Mediterranean and Western Indian Ocean (WIO) regions. It demonstrates that an ICZM Protocol can be a strategic lever to address coastal issues only if certain conditions for its elaboration and implementation are effectively met.  相似文献

The United Nations General Assembly in 2006 and 2009 adopted resolutions that call for the identification and protection of vulnerable marine ecosystems (VMEs) from significant adverse impacts of bottom fishing. While general criteria have been produced, there are no guidelines or protocols that elaborate on the process from initial identification through to the protection of VMEs. Here, based upon an expert review of existing practices, a 10-step framework is proposed: (1) Comparatively assess potential VME indicator taxa and habitats in a region; (2) determine VME thresholds; (3) consider areas already known for their ecological importance; (4) compile information on the distributions of likely VME taxa and habitats, as well as related environmental data; (5) develop predictive distribution models for VME indicator taxa and habitats; (6) compile known or likely fishing impacts; (7) produce a predicted VME naturalness distribution (areas of low cumulative impacts); (8) identify areas of higher value to user groups; (9) conduct management strategy evaluations to produce trade-off scenarios; (10) review and re-iterate, until spatial management scenarios are developed that fulfil international obligations and regional conservation and management objectives. To date, regional progress has been piecemeal and incremental. The proposed 10-step framework combines these various experiences into a systematic approach.  相似文献

Overcapacity is a major threat to the sustainability of tuna resources. Diverse actions are being carried out by tuna RFMOs to counteract this problem. This paper reviews and analyses both the historical development of fishing capacity management in tuna RFMOs and their state of the art practices. Despite the fact, that thus far, management measures have not yielded the expected results for capacity reduction, they provide a good basis for improved management of capacity at regional and global levels.  相似文献

This paper evaluates the international agreements in place for the protection of the environment and the regulation of human activities taking place in world's oceans and seas. 500 multilateral agreements were reviewed against a framework of reference, grounded on the theoretical approaches of Adaptive Management and Transition Management. According to this framework, oceans complex systems management should: (1) consider the global oceans as a Social-Ecological System (SES); (2) aim to achieve or maintain their ecological resilience; and (3) implement iterative, learning-based management strategies, supported by science-based advice to policy and management. The results show that the present international legal framework for the global oceans does not require countries to adopt an adaptive, complex systems approach for global oceans ecological resilience. Instead, this study supports the perspective of a double fragmentation among international agreements. First, global agreements focus on issue-based objectives for determined human activities, ecological components or anthropogenic pressures. Second, regional agreements have a wider scope, but also a varying level of inclusion of ecological resilience considerations. There is the need to foster the inclusion of such an approach into existing and future international agreements and their implementation, including through soft-law, project-based initiatives at global and regional scales.  相似文献

This paper reviews the emergence of the spatial dimension of marine and coastal zone administration, and examines several initiatives around the world that contribute to this idea. Spatial data have been recognised as an important resource to improve decision-making and resource management in both the land and marine environments in terms of sustainable development. Many countries are developing Spatial Data Infrastructures (SDIs) to improve access and sharing of spatial data, however, most of these initiatives stop at the coastline. Recently, global and regional activities such as the 3rd United Nations Convention on the Law of the Sea (UNCLOS) and the Sustainable Development Strategy for the Seas of East Asia (SDS-SEA) have brought to international attention the importance of effective administration of the marine and coastal environments.  相似文献

In 2008, the Convention on Biological Diversity (CBD) adopted seven criteria to identify Ecologically or Biologically Significant Areas (EBSAs) “…in need of protection, in open ocean waters and deep sea habitats”. This paper reviews the history of the development of the “EBSA process”, which was originally driven by the commitment to establish marine protected areas in areas beyond national jurisdiction, but which has since broadened to encompass the possibility of informing marine spatial planning and other activities, both within and beyond national jurisdiction. Additionally, the paper summarizes ongoing efforts through CBD regional workshops to describe EBSAs and the development of the EBSA Repository, where information on these areas is to be stored. The overlap between the EBSA criteria and biodiversity criteria suites used by various authorities in areas beyond national jurisdiction is illustrated. The EBSA process has reached a critical juncture, whereby a large percentage of the global ocean has been considered by the regional workshops, but the procedure by which these areas can be incorporated into formal management structures has not yet been fully developed. Emerging difficulties regarding the mandate to describe, identify, endorse, or adopt EBSAs, are discussed.  相似文献

据地下水中SiO2含量计算山东半岛硅热流值。以此为基础初步探讨本区的地热场特征及其与区域地质条件的关系。指出:1.山东半岛平均热流值与全球平均热流值接近,但比一般古老地块略高。2.划分出三个地热异常区,在大地构造上,两较高热异常区分别对应于胶北和文登隆起;较低热异常区与胶莱盆地相应。3.地热场总特征及其区域热异常的形态主要与近地表的地层岩性、构造形态和断裂发育程度等地质条件有关,而与中生代的岩浆活动无关,但第四纪岩浆活动对胶北隆起局部(蓬莱一带)热异常有重要作用  相似文献

The article describes an on-going struggle between local planning authorities, regional fishery authorities and environmental authorities over the management of the Norwegian coastal zone. Particular reference is made to a recent planning project in Nordland County where 18 peripheral communes with weak planning traditions joined forces to produce structure plans for their coastal areas. Concepts of rationality and power are used as points of departure for an interpretation of the actions of the parties involved. The discursively rational nature of the planning project, embodying principles of consensus building, social integration and personal growth, is contrasted to the strictly instrumental behaviour of regional fishery and environmental authorities. The article also relates conflicts between communes and regional sector authorities to the power structure of the field of coastal management and the habitus of the different institutional actors. The actions of the fishery authorities are seen as a defence of their monopoly of the production of ideology in marine management, while the actions of the communes are interpreted as a bid by the periphery for greater control over local resources.  相似文献

Integrated coastal management (ICM) is accepted world-wide as a comprehensive, multi-sectoral integrated approach to the planning and management of coastal areas. ICM is particularly suited to the island member countries of the South Pacific Regional Environment Programme (SPREP) because of their size, the interconnectedness of the coast and terrestrial areas and the high degree of association and community involvement with the management of coastal systems. With the exception of the highly migratory pelagic fish stocks, the narrow natural resource base of many Pacific islands make them particularly vulnerable to inappropriate development and mismanagement. Fortunately, the governments of many Pacific Island countries (PIC) have become aware of the benefits of integrated coastal management and are looking at ways of making it an established practice. This paper uses the framework of ICM to illustrate some of the author's experience of coastal management within the South Pacific region. Within the ICM framework, a range of tools and techniques are available to manage coastal problems. The success of any approach depends on the scale and magnitude of the problems to be addressed and the availability of information, institutional support and commitment from all stakeholders. The way in which programmes are conducted and implemented is particularly important. Top down initiatives may work at the regional level but tend to fail at the national and community level unless there are other incentives to support them. On the other hand, bottom up, process driven initiatives have enjoyed more success at the community level. Demand-based approaches have tended to be very successful at all levels, whether they be at the community, country or regional levels, particularly where all of the interested parties can collaborate and contribute to finding solutions to their problems.  相似文献

近海的生态环境问题态势严峻。在机制上,普遍认为富营养化是导致近海环境恶化的主导因子,但实际上,营养盐的结构失衡对近海生态环境问题的产生可能起到了更重要的作用。目前关于营养盐结构失衡的主导因素和机制尚缺乏全面系统的研究。本文基于对已有数据和文献资料的整合分析发现,由于存在强烈的人类活动影响,中国近海营养盐结构失衡问题较过去更为突出,且可能引发潜在“磷消耗”问题,其影响在某种程度上较传统意义上的磷限制要强,并进而产生深远的生态环境效应。据此提出,今后相关的研究应该特别关注河流流域-近海环境变化和它们之间的内在关联,阐明控制近海营养盐浓度、形态、分布和结构的关键生物地球化学过程,量化近海氮与磷的滞留机制与效率,揭示浮游植物群落结构变化与营养盐结构失衡和磷消耗的耦合关系及其生态效应等,最终制定中国入海河流与近海氮磷协同控制的适应性管理措施。  相似文献

The 1972 United Nations Conference on the Human Environment (Stockholm, UN Conference, 1972) outlined a ‘masterplan’ linking environmental assessment, environmental management and supporting measures as basic and inseparable elements of environmental actions plans. It also indicated the advantages of a regional approach in contributing to the solution of global problems. The Regional Seas Programme of UNEP (United Nations Environment Programme) was subsequently initiated in 1974 (UN General Assembly, 1972). Development of UNEP’s Regional Seas Programme demonstrated that the basic concepts formulated at Stockholm can effectively foster regional cooperation among interested States, and may benefit from the support of the United Nations system as a whole.The present Regional Seas Programme includes fourteen regions, comprising over 140 coastal States. It was conceived as an action-oriented programme encompassing a comprehensive, trans-sectoral approach to marine and coastal areas and to environmental problems, considering not only the consequences, but also the causes of environmental degradation. Each Regional Seas Programme is based on the needs of the region concerned. The Regional Seas Programmes promote the parallel development of regional legal agreements, and of action-oriented programme activities, as embodied in the action plans. The overall strategy to be followed, as defined by UNEP’s Governing Council (UNEP, 1974) is:
  • 1. Promotion of international and regional conventions, guidelines and actions for the control of marine pollution and the protection and management of aquatic resources.
  • 2. Assessment of the state of marine pollution, pollution sources and trends, and of the impact of pollution on human health, marine ecosystems and amenities.
  • 3. Coordination of efforts with regard to environmental aspects of the protection, development and management of marine and coastal resources.
  • 4. Support for education and training efforts to facilitate the full participation of developing countries in the protection, development and management of marine and coastal resources.
Because the goal of each Regional Seas Programme is to benefit the States of that region, governments are involved from the very beginning in the formulation of the action plan. After acceptance, the implementation of the programme is carried out, under the overall authority of the governments concerned, by national institutions nominated by their governments. Although the Regional Seas Programme is implemented primarily by government-nominated institutions, specialized United Nations bodies, as well as the relevant international and regional organizations, contribute to its formulation, and also provide assistance to these national institutions. UNEP acts as an overall coordinator for the development and implementation of regional action plans. In some cases, this role is limited to the initial phase of the activities.  相似文献

The ocean regulates the global climate, provides humans with natural resources such as food, materials, important substances, and energy, and is essential for international trade and recreational and cultural activities. Together with human development and economic growth, free access to, and availability of, ocean resources and services have exerted strong pressure on marine systems, ranging from overfishing, increasing resource extraction, and alteration of coastal zones to various types of thoughtless pollution. International cooperation and effective governance are required to protect the marine environment and promote the sustainable use of marine resources in such a way that due account can be taken of the environmental values of current generations and the needs of future generations. The high seas deserve particular attention since they suffer from a number of regulatory shortcomings due to the basic structures set out under international law. Against this backdrop, developing and agreeing on a focussed Sustainable Development Goal (SDG) specifically for the Ocean and Coasts could prove to be an essential element to provide guidance and a framework for regional implementation agreements.  相似文献

There is concern in England and Wales over the complexity and short comings of the current arrangements for coastal hazard planning and management. At a time of major constitutional reform involving a strengthened role for regional government, the UK needs to learn from other countries with a strong regional dimension which have developed successful systems for coastal hazard planning and management. New Zealand provides such an example. Recent local government reform and the ‘revolutionary’ Resource Management Act (RMA) 1991 have created a new organisational and administrative framework for coastal hazard planning and policy development in New Zealand which fosters integration, involves all levels of government and extends offshore. This paper provides a comparison of the regional dimension of coastal hazard planning in the two areas, focusing on the status, scope and jurisdiction of regional planning bodies and initiatives as well as investigating issues relating to intergovernmental and cross-sectoral links and public involvement. Although the widely acclaimed RMA is not the panacea for coastal management it was once hoped to be, the New Zealand experience illustrates the advantages of clearly defined roles for different levels of government, with emphasis on regional decision-making and extensive community involvement.  相似文献

The life spans of demersal species of fishes occurring in deep-waters are much longer and their potential growth rates much lower than those of related shallow water species. As a result, deep-sea demersal fish species are more vulnerable to exploitation. This is because low growth rates relative to the available market discount rate for capital makes it desirable for fishing firms to mine, rather than sustainably exploit, these resources even in the absence of fisheries subsidies. However, it is common knowledge that governments around the world do provide subsidies to their fishing industries. The objective of this contribution is to estimate the global amount of subsidies paid to bottom trawl fleets operating in the high seas, i.e., outside of the Exclusive Economic Zones of maritime countries. Our study suggests that fisheries subsidies to these fleets stand at about US$152 million per year, which constitutes 25% of the total landed value of the fleet. Economic data for bottom trawlers suggest that the profit achieved by this vessel group is normally not more than 10% of landed value. The implication of this finding is that without subsidies, the bulk of the world's bottom trawl fleet operating in the high seas will be operating at a loss, and unable to fish, thereby reducing the current threat to deep-sea and high seas fish stocks.  相似文献
