In March 1996, China fired missiles near Taiwan’s two largest ports, namely, Keelung in the north and Kaohsiung in the south. The event disrupted sea and air transport in the area and was considered as a ‘partial blockade’ of Taiwan. China’s missile tests conducted in the waters of the Taiwan Strait give rise to several international law questions, such as: did China’s missile tests amount to a blockade of Taiwan and accordingly are subject to the international law of blockade: and does China, as a member of the United Nations, have the right, under international law, to fire missiles across the Taiwan Strait to intimidate Taiwan. This paper addresses these legal issues. This paper concludes by suggesting that China’s missile tests, in legal terms, did not amount to a blockade, but a military operation at sea, and that China failed to pass the reasonableness test for justifying its missile tests on the high seas and, thus, could be seen as in violation of international law. However, a caveat is given in the conclusion, that is, the legality of China’s missile tests in the waters so close to Taiwan’s coasts cannot but be appraised in the context of how other members of the international community view Taiwan’s legal status and the position they take regarding whether the Taiwan question is indeed entirely an internal matter of China.  相似文献

On account of the “legal transplant” of French civil law into traditional customary law in Madagascar, the traditional social code generally known as “Dina” has coexisted with the modern law since the pre-colonial era and has conditioned the implementation of such law. The concept and use of Dina has been influenced by that process.This paper illustrates the role of Dina as a mechanism for reconciling modern decentralized and traditional governance of marine resources and the coastal zones in Madagascar. Democratic participation is important for enforcing the regulations governing marine resources and coastal zones. As law should be the will of people themselves, it is therefore necessary to develop legislation in community forum such as through Dina. It is especially critical that regulations be imbued with community aspiration and culture so that the population can respect laws freely.The three cases cited in this paper illustrate the different ways in which Dina may be used depending on the interests of the actors. Integrating the ‘legal’ and the ‘legitimate’ is a big challenge. In some cases, this legal mechanism is not successful at protecting local community or fishermen rights. Given the potential for integrated coastal zone management and community-based management, Dina may be strengthened in order to more effectively protect local people's rights.  相似文献

This contribution is a response to the rebuttal of Agnew et al. (2012) to Froese and Proelss (2012) “Evaluation and legal assessment of certified seafood”. It corrects some factually wrong statements in the rebuttal, revisits the definitions of ‘depleted’ and ‘overfished’, and notes that the rebuttal agrees with the international definition of ‘overfishing’ (F>FMSY) that was used by Froese and Proelss (2012). The rebuttal presents an analysis of 45 MSC-certified stocks. Of these, 27% are ‘depleted’ (according to the definition used by MSC) or ‘overfished’ (according to the definition used by Froese and Proelss 2012) and 16% are subject to ‘overfishing’, basically confirming the critique of Froese and Proelss (2012). This response concludes that MSC has to change its rules for certification such that (1) overfishing is not allowed and (2) ‘depleted’ stocks are marked as such.  相似文献

The exposed area of intertidal zone varies with tidal water level changes. If intercomparisons of satellite images are adopted as a method to determine geomorphological changes of the intertidal zone in response to accretion or erosion processes, then the e?ect of water level variations must be evaluated. In this study, two Landsat TM images overpassing the central Jiangsu coastal waters on 2 January and 7 March 2002, respectively, were treated by the changing detection analysis using Image Di?erencing and Post-classiˉcation Comparison. The simultaneous tide level data from four tide gauge stations along the coast were used for displaying the spatial variations of water levels and determining the elevations of waterlines. The results show that the spatial variations of water levels are highly signiˉcant in the central Jiangsu coastal waters. The huge di?erences of tidal land exposure patterns between the two imaging times are related mainly to the spatial variations of tidal water levels, which are controlled by the di?erences in tidal phases for di?erent imaging times and the spatial variations of water level over the study area at each imaging time. Under complex tidal conditions, e.g., those of the central Jiangsu coastal waters, the tide-surge model should be used to eliminate e?ectively the e?ects of water level variations on remote sensing interpretation of geomorphological changes in the intertidal zone.  相似文献

Coastal environments are complex systems undergoing continuous evolution at a range of spatial and temporal scales. In this context, geomorphological and ecological features can be strongly related. We propose a synoptic remote sensing approach to monitor the temporal dynamics of both biotic and abiotic factors in estuarine and coastal ecosystems. Through the combination of spaceborne optical and SAR imagery, we derived both ecological and morphological parameters, to be integrated for a multi-temporal analysis of the dominant processes and trends in coastal landscapes. These dynamics were studied at three locations: Bevano (IT), the Scheldt (B-NL) and Erme (UK). The objectives were to detect and analyze interannual variations of processes and environmental dynamics.The results highlight that over time, the morphology of different subsystems represents a balance between inputs (forcing agents like tidal range) and natural responses (related responses of the vegetation evolution). As a final remark the calculation of the uncertainties (subsidence rates) using new monitoring techniques such as satellite remote sensing has a specific added value that could be used for simulations over varying time scales and it should be considered as a potential ‘add in’ for an integrated management approach to coastal monitoring and control.  相似文献

The sedimentary structures, composition, and texture of sediments from the barrier coast complex (Matarangi Beach—Omaro Spit—Whangapoua Harbour) at Whangapoua, Coromandel Peninsula, are described. Sediments are mainly fine sands, rarely muddy or silty, and most are plagioclase feldsarenites, reflecting derivation from a predominantly Tertiary volcanic hinterland. Sediments from each of the modern environments, namely nearshore, foreshore, back‐shore, frontal dunes, tidal flats, and tidal channels, are characterised by a particular combination of sedimentary structures and subtle textural parameters. Dune ridge and barrier flat paleoenvironments on Omaro Spit were successfully identified by comparing their lithologic properties with the modern sediments. ‘Surficial’ sediments of the well‐preserved dune ridge system developed immediately inland from Matarangi Beach closely resemble those in the modern frontal dunes, and the ‘in depth’ dune ridge sediments are more analogous to the present foreshore sands. The barrier flat deposits separating the dune ridge system from Whangapoua Harbour have similar characteristics to the modern tidal flat sediments in the harbour.

Omaro Spit probably began as an offshore bar across the mouth of Whangapoua Harbour, an embayment formed by the post‐glacial drowning of a Late Tertiary dislocated fault‐block. Tidal flat sedimentation within the harbour formed the ancient barrier flat deposits which rise to at least 2 m above the modern harbour flats, suggesting local sea level at the time was higher than at present. During a subsequent cyclic fall in sea level, supratidal aeolian deposition led to a succession of 15 to 18 parallel dune ridges developed on high‐tide berms. Linear regression analyses of dune ridge and swale heights and the height distribution of positive (aeolian) and negative (beach foreshore) skewness values and of contrasting sedimentary structures in dune ridgL paleosediments, together with the stages in dune soil development across the barrier, suggest initial sedimentation occurred from 4000–5000 years ago when local sea level was 2–3 m above present mean high water level. Barrier progradation was interrupted by an important period of coastal erosion during a temporary rise in sea level immediately before deposition in the dune ridge system of a layer of 2000‐year‐old sea‐rafted Leigh Pumice. Sea level probably reached its modern position at Whangapoua about 1000 years ago, since when some evidence suggests the barrier spit may have experienced minor uplift.  相似文献

The development of criteria for the identification of ‘High Risk Vessels’ (HRV) in European waters would allow coastal States to monitor the movements of ships posing significant risk to their interests. However, the pro-active monitoring by coastal States can only be carried out in compliance with the requirements of international law of the sea and with the framework of rights and duties of coastal States established in the UN Convention on the Law of the Sea. This paper proposes ‘HRV’ criteria on the basis of technical standards and rules widely accepted by States through Port State Control Agreements, thus providing a legal basis for the monitoring of ‘HRV’ by coastal States.  相似文献

The intertidal zone around the Suva Peninsula, Fiji, supports separate finfish and invertebrate subsistence fisheries. This important source of fresh marine food for many low-income families around metropolitan Suva is under threat from foreshore reclamation projects and from anthropogenic biochemical pollution. Damage to or loss of this invertebrate intertidal fishery would remove a significant area where urban dwellers can pursue this traditional (non-cash) means of seafood acquisition. In 1996, Suva Peninsula was considered for the development of a marina, hotel, aquarium, roads, walls, and other structures. There is also increasing evidence of a serious anthropogenic TBT (tributyltin) pollution threat to the local invertebrate fishery. Although this substance is well known to have ecologically deleterious effects, its use is unregulated in Fiji. The inputs are likely to be large commercial vessels, and in particular the shipyards around the west side of Suva Harbour, where TBT antifouling coatings are both applied and removed, the old paint debris being allowed to wash into the harbour. Inputs from small boats are probably less important as there are relatively few (<150 boats) but uses of TBT, as a wood treatment chemical, for example, may lead to other inputs (but these have not been investigated). Samples of Anadara antiquata and Gafarium tumidum contained high levels of TBT ranging from <50 ng TBT gm−1 to 240 ng TBT gm−1. Samples of the edible bivalve G. tumidum taken from the Lami Dump intertidal zone had accumulated 10,500 ng TBT gm−1. The values of TBT in Suva Harbour and Laucala Bay sediments have reached levels that are among the highest in the world and indicate that these sediments are functioning as geochemical sinks for this toxic organotin substance.  相似文献

The red seaweed genus Asparagopsis Montagne (Bonnemaisoniales) contains two widely introduced species that are considered notorious seaweed invaders worldwide, Asparagopsis armata and A. taxiformis, both characterised by heteromorphic, diplo-haplontic life histories. To uncover cryptic introductions of Asparagopsis along the South African coastline and identify ‘Falkenbergia’ isolates (i.e. tetrasporophytic life-history phase morphologically identical between species), the mitochon-drial cox2–3 spacer was sequenced from gametophytes of Asparagopsis taxiformis from Scottburgh, KwaZulu-Natal, on the East Coast, Knysna Lagoon on the South Coast and from tetrasporophytes, otherwise unidentifiable to species level, collected from False Bay near Cape Town on the South-West Coast and Tsitsikamma on the South Coast. Only tetrasporophytes of the temperate Asparagopsis armata were encountered from the Cape Peninsula (Cape Town) probably as far east as to Port St Johns, Eastern Cape province. This is considered an introduced species, and was first collected at Kommetjie (Cape Peninsula) in 1935. Gametophytes of the warm-temperate to tropical A. taxiformis were first collected at Reunion Rocks near Durban in 1984; the KwaZulu-Natal material studied here belongs to an Atlantic Mediterranean cryptic lineage. This taxon is an ecological dominant in some intertidal and shallow subtidal areas in northern KwaZulu-Natal, and is thus considered ‘introduced’ and ‘invasive’. In contrast, A. taxiformis gametophytes, collected in Knysna Lagoon in 2008, clustered with individuals of Indo-Pacific lineage 2. The latter is considered a major invasive lineage in the western Mediterranean, but at present is categorised as introduced in South Africa. This study provides molecular evidence of three independent, cryptic introductions in South Africa, one of them probably very recent, and this is discussed with respect to potential vectors responsible for transport.  相似文献

Notwithstanding the wide range of actions taken to strengthen the legal regime of international fisheries, overexploitation and the risk of depletion of stocks have been strong concerns for decades. Indeed, the regime of international fisheries law is currently not rooted in sustainability, and it does not adequately take into consideration the impact of fishing activities on the wider marine environment. One of the main causes lies in fragmentation of international fisheries law: a lack of coordination between instruments and institutions, and gaps in effective coherent structures for fisheries management. Areas beyond national jurisdiction (ABNJ), including the high seas, are particularly prone to this lack of coordination and integration.One alternative to reach a durable management of high seas fisheries might be found in a ‘global oceans governance approach’. This paper explores how this approach could impact the fragmented regime of fisheries. It suggests that governance-based perspectives underline concepts rooted in adaptability and interactions, concepts that suggest to approach international fisheries law not as a static set of rules but as an evolutive process. Reflecting on an overarching goal of coordination and possible management challenges in ABNJ provides an interesting starting point to develop a comprehensive understanding of the impacts of oceans governance on the fragmented legal regime of high seas fisheries. We now need to see how to give effect to governance, a task that remains, at this point, a work in progress.  相似文献

基于0709号台风"圣帕"影响下粤东后江湾的现场实测海滩前滨地形资料和水动力、风等资料,采用典型相关分析方法识别了台风影响下海滩前滨地形不同的变化过程,揭示了这些不同变化过程的主要控制因子,并尝试给出了物理解释。研究结果表明:(1)台风影响下海滩前滨地形的主要变化过程是水上滩肩被破坏—水下岸坡略有堆积—水下沙坝泥沙向海搬运,控制这一过程的主要动力因子是风速东向量、最大波高和碎波尺度参数;(2)海滩前滨地形的次要变化过程是海滩前滨泥沙向海搬运而形成水下沙坝,控制这一过程的主要动力因子是最大波周期和海滩地下水位;(3)海滩前滨地形也表现出前滨上部地带堆积、下部侵蚀的变化过程,控制这一过程的主要动力因子是沿岸流、海滩地下水位和最大波高。这些研究结果进一步揭示了台风影响下海滩前滨地形动力过程是由多个不同的地形-动力过程耦合作用而组成。  相似文献

Worldwide, urbanisation has resulted in extensive replacement of natural habitats with man-made habitats. In Sydney Harbour, Australia, approximately half of the natural foreshore has been replaced by seawalls. Many of these have wharves built over part of their length, which could affect intertidal assemblages on seawalls beneath the wharves. This was tested by sampling and comparing assemblages under and not under wharves in Sydney Harbour. Assemblages differed between the two habitats, with greater cover of macro-algae and abundance of grazing molluscs on seawalls without a wharf and, to a lesser extent, greater cover of sessile invertebrates on seawalls under a wharf. There was, however, considerable spatial variability among locations in composition of assemblages and the species dominating differences between the two habitats. The impact of multiple artificial structures in close proximity and the variability among apparently homogeneous artificial habitats must be considered for the management of urbanised estuaries.  相似文献

Estuarine tidal flats are both ecologically and economically important, hence developing methods to reliably measure ecosystem health is essential. Because benthic fauna play a central role in the food web of tidal flats, in this study we set out to quantitatively describe the intertidal zonation of macro-invertebrates and their associations with specific environmental parameters along three transects in the Saemangeum tidal flat, Korea. The abundance and biomass of intertidal fauna with respect to five environmental parameters (i.e., shore level, mud content, coarse sand content, water content, and organic content) were measured, to identify environmental factors that influence macrofaunal distribution in intertidal soft bottom habitats. A total of 75 species were identified, with dominant species showing distinct zones of distribution along all transects. The number of species recorded in each transect was found to be dependent on sediment characteristics and salinity. Cluster analysis classified the entire study area into three faunal assemblages (i.e., location groups), which were delineated by characteristic species, including (A) ‘Periserrula–Macrophthalmus’, (B) ‘Umbonium–Meretrix’, and (C) ‘Prionospio–Potamocorbula’. Four environmental variables (i.e., shore level, water content, mud content, and organic content) appeared to determine factors that distinguished the three faunal assemblages, based on the discriminant analysis. The faunal assemblage types of the sampled locations were accurately predicted from environmental variables in two discriminant functions, with a prediction accuracy of 98%. It should be noted that the zonation of benthos in the lower section (C) of Sandong had been affected by the construction of a nearby dike, while this parameter had remained essentially unchanged at the other two location groups (A–B). Overall, the zonation of benthos from the Saemangeum tidal flat was explained adequately by the measured environmental variables, implying that faunal assemblages are closely associated with certain combinations of abiotic factors. The identification of such reliable associations may facilitate the development of statistical models to predict faunal distributions based on environmental variables at both local and regional scales. The entire study area was embanked in 2006 (one year after this study), and an integrated plan was set into force to develop claimed land into industrial, residential and agricultural districts, which also included a partial restoration program of the tidal flats located near to the study area.  相似文献

Hong Kong (HK) has enacted laws providing: (1) Regimes that address pollution prevention responsibilities for parties involved in shipping activities to ensure that ships used in HK waters comply with applicable rules and standards; (2) civil damages remedy for wrongful death, personal injury or property damage caused by an environmental incident; and (3) a system of penalties to address the rare cases where the behavior of the polluter is considered intolerable and must be punished as a criminal offence. Being acquainted with this legal and policy framework is of beneficial interest for the maritime industry in HK. This article first summarizes the existing general legal framework, and later presents the results of an empirical study to determine what repercussions there could be within the HK maritime industry as a result of these laws and policies being applied in cases that result in civil liability compensation and criminal charges. The empirical research demonstrates that the laws and policies are in general sufficient and effective, but that flaws still remain in the limitation of liability scheme, as well as uncertainties as to which particular kinds of environmental violations should result in either civil or criminal enforcement. To address these concerns, it is first suggested that HK should impose greater liability in areas where prior law provided insufficient liability, as this will act as a more potent deterrent; and second, that HK should clearly delineate an appropriate role for criminal enforcement in the environmental regulatory scheme, so as to lessen concerns about over-criminalization.  相似文献

全球气候变化及其引发的负面影响是当今人类面临的最大挑战之一,地球工程因被认为是减缓甚至扭转气候变化的切实可行的方案之一而备受关注。为推动地球工程技术的发展和相关国际法的完善,文章分析海洋施肥、人工上升流、人工海洋碱化、海洋云增白和海底造墙5种海洋地球工程的技术原理、研究进展及其在具体实施中对现行国际法的挑战。研究结果表明:无论是处于理论模拟阶段还是处于实验阶段,上述海洋地球工程技术都显示其减缓气候变化的潜力,同时也存在对海洋环境和人类生活的潜在风险;由于科学的不确定性和国际法的模糊性,各项技术在实际应用中都存在与国际法的冲突或适用问题,但目前从科研实践角度分析具体技术涉及的相关国际法问题的研究较少;虽然应在国际法框架下进行探索性研究,然而目前有关地球工程技术的国际法在理论研究和实践应用中仍存在很多争议。因此,必须加强对地球工程技术的研究,将技术风险降到最低,并在科学探索中做好环境基线研究,完善技术探索的环境影响评估方法;随着旨在减缓气候变化的小规模地球工程研究得到越来越多的支持,更应明确地球工程技术在国际法中的地位,建立合理的法律框架,推进国际法的改进。  相似文献

The law of the sea has always been open to the charge of being a ‘covenant without a sword’ and its effectiveness when challenged by the perceived national security of a superpower is questionable. Attempts to limit and control antisubmarine warfare (ASW) have demonstrated that neither superpower is prepared to risk its second-strike capability for what may be an illusory legal protection. This article reviews developments relevant to ASW in the law of the sea and describes the significance of ASW to the superpowers' strategic objectives. Coastal wetlands provide important ecological services to the coastal zone, one of which is sediment retention. In this study we investigated sediment retention across a range of geomorphological settings and across vegetation zones comprising coastal wetlands. We selected six coastal wetlands dominated by mangroves over a gradient from riverine to tidal settings in Southeast Queensland, Australia. Each site was comprised of three distinct vegetation communities distributed as parallel zones to the coast line: seaward fringe mangroves, landward scrub mangroves and saltmarsh/ cyanobacteria mat of the high intertidal zone. We measured suspended sediment retention and sedimentation rates. Additionally, in order to assess the origin of sediment transported and deposited in the mangroves, glomalin, a novel terrestrial soil carbon tracer, was used. Our results show a mean average sedimentation of 0.64 ± 0.01 mg cm−2 spring tide−1, which was variable within sites, regardless of geomorphological setting. However, geomorphological setting influenced spatial patterns of sediment deposition. Riverine mangroves had a more homogeneous distribution of sediments across the intertidal zone than tidal mangroves, where most sedimentation occurred in the fringe zone. Overall, the fringe zone retained the majority of sediment entering the coastal wetland during a tidal cycle with 0.90 ± 0.22 mg cm−2 spring tide−1, accounting for 52.5 ± 12.5% of the total sedimentation. The presence of glomalin in suspended sediments, and thus the relative importance of terrigenous sediment, was strongly influenced by geomorphological setting, with riverine mangroves receiving more glomalin in suspended solids than tidal mangroves. Glomalin was also differentially deposited within the vegetation zones at different geomorphological settings: primarily at the fringe zone of tidal mangroves and within the scrub zone of riverine mangroves. The differences we observed in the spatial distribution of sedimentation and the difference in the origin of the sediment deposited in riverine and tidal mangroves are likely to have an impact on ecological processes.  相似文献
